putting money up when wages are still the same

when we first started the IVA we were quoted a sum of money which we agreed to, but when it came later on we were told that the creditors would not accept the money we were asked to pay, in there words laughed out of court, so we agreed to the sum they asked,then come the waiting period but no money was taken, we left the sum in the bank, when i looked at the date they hadnt taken the money, so i rang them, they said we had missed 2 payments i said i dont see how, but they told me that they had changed bank accounts, we were not told this, but they put the money up by £40 extra a month, even tho we were struggling it didnt matter to them.

Then something awful happend i was under the hospital and my husband said he couldnt manage to pay this month, he rang them after all the solictor said just get intouch if we come into difficulties, anyway he phoned them and told them told them what happend and again said we are putting up the money to over £300, even tho my husband told them it was hard to get the money this month with only one wage,they then said this was the last time they would help that next time they would take us to court, my question is can they keepdoing this putting our money up when our wages are still the same if not worse sometimes.

Your Supervisor cannot keep putting up the money, unless you are in arrears and it is with your agreement or your circumstances change to warrant you paying more money. Which firm are you with?

The original people who first quoted us was First Direct, they then passed uson to solicitors who are called Beesley & Company.
To answer your question yes we are in arrears, one through no fault of ours through their delay from their bank to our bank, the second none payment was through myself and my husband not being able to work, which we explained to the solicitors when my husband rang them, he did tell them by them putting up the money each month we were finding it difficult.
The intial meeting with them we told the solicitor that we can just about be able to pay the sum of money which was £251, the solicitor told us it was better to phone them if we had any problems regarding money, which we did and that was the response we got saying that our money was to be put up or the agreement was broken and that if there was another time like this the hey would terminate the contract.

Are you actually in an IVA or is this a payment agreement that you have with one creditor ?
