Firstly,ive read the forums and all your advice is top class,good work.
I have a failed IVA and the Insolvency co. has put me into the bankruptcy court for a hearing at the end of the month.im not in a position to pay a good chunk of the debt til mid September as im self employed.i intend to make a small token payment this week.What shall I say to the judge in the hearing? Im really scared as I dont want to go bankrupt,I can take documents into court to prove that the money is owed to me.Thanks in advance.

Hello Running Man

It's fairly unlikely that the judge will adjourn the bankruptcy hearing unless your Supervisor supported it.In the circumstances you need to get the Supervisor on your side.

It sounds as though your cashflow has gone awry making it difficult for you to meet your contributions at the moment but if you really do think that you can catch up and can prove that to the Supervisor, it might be possible to come to some arrangement to catch up with your payments and/or propose a variation to the arrangement.

You've left this all rather late and I suspect haven't responded to the Supervisors requests for you to make payments or get in touch but there is still time to get them on your side.

A very slim chance I would say under the circumstances. Are you a property owner or do you have other assets which would vest in a Trustee in bankruptcy?
