That is the subject of ongoing litigation at present ginger, which may result in creditors being held to have acted inappropriately in keeping the proceeds of the claim to off-set against their debts. As you can appreciate this is a very fluid issue at the moment, as most of us try and make sense of what is the right and proper way to approach claims for our clients.

I can honestly say - i will be glad when this "bandwagon" runs out of steam

It was only a few days ago that the bank and credit card companies signed a agreement to start to challage claim companies in their applications for refunds of ?? misold PPI

well said ginger3232! its a complete nightmare! no one really understands whats going on so until, as the above IP mentions, i feel all IPs should wait until a complete guideline is written up and is passed to all IPS i really do feel for the IPS if i am frank about it as they have, like its been said, thrown in the deep end! i just hope that this can all be sorted out as it seems no one is really getting any clear answers!!

I am not convinced that there will be a best practice guideline forthcoming from the regulators - I am intending on speaking to my own shortly to canvass their views.

this is very true i think as they is so much more to look into and everyone needs to be pulling in the right direction. banks,IPS,IVA customers and the regulator. we will wait and see but this will be miles away yet and as such will not help the people on here at the momment.
