PPI Post IVA With A Difference

I completed my IVA in 2011. It took almost one year to receive my completion certificate - I'd add that this only occurred following much pestering, bad publicity on here (possibly) and finally complaints.

I've been away from home for a couple of weeks & amongst the post was a letter from my old, or so I thought IP firm - The Debt People AKA Money Plus Group congratulating me on completing my obligations under my IVA & then going on about PPI. Without boring you with all the details they are requesting that I pursue these possible compensation claims. I am requested to:

1) Sign the Letter of Authority
2)Sign The Financial Ombudsman Declaration Form
3)Sign the questionnaire to substantiate the reason for making a mis-sold PPI claim.
4)Return in the pre paid envelope within 7 days (no chance as that date as already expired)
5) Keep this letter for your records

Amongst other things, in the letter of authority/POA it refers to the fact that as long as the IVA remains in force blah, blah. Really, so what about my completion certificate?

Oh, I should also mention that they have negotiated a discount for their clients that have completed their IVA's. No win no fee and successful claims will be charged 20% plus VAT on the amount recovered.

To say I'm furious is an understatement. Let's just say that I never have and never will forgive this company for the misery I was forced to endure while awaiting my completion certificate. I never wanted to hear from them again but, anyhow, seeing as they've re-opened the wound, I will again dissuade anyone reading this not to use their services.

As for the PPI, I don't believe I was mis-sold it, I have never had any intentions of reclaiming it whether for my personal gain, or not, despite of the numerous offers from parasitic companies offering to do this on my behalf. All I want to do is move on from this sorry chapter in my life - something I felt I'd done until I received this letter.

Can anyone advise/recommend on what action I should take? I'm tempted to do nothing - I already have my completion certificate & any discussion wont be civil I can assure you. It's probably a good thing they were closed when I read this as my instant reaction would have been to pick up the phone & tell them what to do using language that I wont post on here. [:(!]

Are they simply canvassing you as a prospective client for PPI reclaim work - which they are going to allow you to keep seeing as your IVA concluded two years aga? Or are they saying that you need to pursue all PPI mis-selling claims, as they money which may be due to you will need to be paid to creditors who were bound by the IVA?

They are requesting, exact wording is that 'I request you to pursue these possible compensation claims' & if I'm reading the Letter Of Authority correctly, the money will go to my creditors.

Ask them on what basis are they now pursuing you. The recent regulatory guidance issued by IPs makes it clear that IPs have no duty to pursue mis-sold PPI on cases where they have ceased to act.

Thanks Melanie, I will do just that. Although, as I mentioned in my first post, the request was that respond within 7 days. This has elapsed as I was away from home & it's 14 days now - is this likely to cause a problem?

Are you saying Mel that due to new regulations that anyone with a cert can claim ppi and have the amount paid to them instead of closed Iva???
5 years done and dusted. Certificate received.

No - I am just staying that IPs are not compelled to investigate. If you choose to make a claim, the money may still be due to creditors who were included in the IVA (depending upon the terms of the IVA proposal)
