Im been on a IVA since May. Everything is going well but I had received my credit file and found that I owe some money to British gas (20 quid) which i paid last friday and to Vodaphone. I have started to pay Voda phone 70 for 6 months as i want if off my file and I sure i cannot include it in my current IVA.

I not sure if im doing the right time?

Also i found that i had an old court order from 2003. I have contacted the creditors and they have told me that is has been paid off and thay have sent details to the court to tell them this. The court have had nothing. Im starting to get annoyed becaue at first the creditors told me that they could not find my files and i keep calling bacuase i want them to act. My question is, How long should they be keeping my records on their system? Im ready to seek legal advice because i smell a rat!!!

Any defaults will remain on your credit file for 6 years from the date they were lodged.

I would tell your IP about the Vodaphone debt. It will just be added to your IVA and as its such a small ammount, it will make very little difference to the end dividend

You may find that you get defaults registered after the date of your IVA. Nothing to worry about - once your IVA is completed just write to the creditors to tell them to remove them. No defaults should show after the date the IVA was approved.

You shouldn't be showing any creditor preferentially payments all debts up to the date of your IVA should be included and they have to abide to the original IVA did you list Vodafone. Send them a letter advising of your IVA and then when your IVA is complete this debt should and will be removed. Having an extra £70 a month to pay Vodafone is alot of extra money (when in an IVA) if your IP is made aware of this then it could go against you. You have only been in IVA since May so get all these debts put in your proposal get the slate clean your file will be shot for 6 years irrespective if you complete early or pay bits off. As plastic said it wont effect didvidend. Your chance to sort all your debts out!! dont be bullied and dont be fobbed off !! Good luck X K

You should be able to add debts mistakenly missed, but just discuss with your IP any implications this might have
