Hi all

Just a quick update.
I still haven't had a call back from Blair Endersby so I'll be ringing them up again shortly.
I've had my final settlement and its a pathetic £3K. For 12 years service that is rubbish. As well as that my car finally died the weekend. The garage have said it will cost more than the cars worth to fix it. They say bad luck comes in 3's so I wonder what is next?

With my redundancy money I'm going to have to get a car. Obviously not an expensive one, just one for about £1500 - £2000. Do you think my IP will allow me to do this?

If you need a car to let you look for a new job then I wouldn't think that there would be a problem with you keeping some of the money for this, but hopefully one of the professional will be able to confirm.

Thats what I thought.
I called up again yesterday and was told that my IP (Karen Marsden) was going to ring me back but nothing yet again.
I'm going to ring them again this morning and if I get no reply again, I won't bother telling them about it and just carry on making my monthly payments.
Just so frustrating, called them up 4/5 times now with the promise of a call back but nothing. GRRRRRRRRRRRRRRR

Im so sorry your dealing with alot on your plate at the moment. Also being a client of BE Ive yet to speak to an IP n only ever spoken to my case manager.

Bit confused whom the name you stated above is?!
You should of had a letter a few weeks ago stating our IPs have changed to Ms Antoinette Thorpe & Mr Peter A Jackson. If you go to the insolvency register n find the search bit for find an IP - you can get a email address for both of them at BE & confirmation that these are our IPs now. Hope this helps run things along a bit quicker for you - would hurt to drop them an email.
PS: If for any reason you cant find it - add me as a frugal friend n I will send you an email.

Hi

Finally got a reply. Apologies, she is my case manager.
She has told me that I need to send them 3 items
-Final Pay Slip
-P45
-Official letter of redundancy

What ever amount I get is classed as a windfall so really I have to pay 50%? Is this correct? Or will I have to pay it all?
If I was to recieve £0 redundancy then they would ask for a 6 month reprieve.

I'm only going to get a small amount (despite working 12yrs) and I don't want to pay it all out!!

Hi - nice to see they got back to you, thought it might your case manager.
The info they are requesting sounds reasonable as for the redundancy money I am unclear on that one.
I do know windfalls usually have to be paid across, for example a small win on the lottery. But with redundancy, surely some of it should be allowed to keep you afloat till you get another job. I would keep this bumped up till one of the more experienced members come along.

There are options of taking a payment break till you get another job (not easy these days) & the frustration of having to put the IVA on hold. I really hope you can manage to get sorted.

The amount of the windfall that you will be required to pay across will be dictated by the terms of your IVA.

She did say that they will leave me enough to live on but will have to go through a new expenditure thing. And as I said before, my car blew up so I now have no means of transport to get to and from work/interviews. I'm using taxi's to get to work and walking home. Priced it up and its going to cost me £35 a week (£7 there). £70 if I wanted taxi home as well.
I sort of wish I wasn't honest with them now.

Hi Wannabedj,

I can totally understand how your feeling - especially with the car breaking. Have you explained to BE about the car & needing it for transport to further your chances of employment & needing a car once employed again?

Forum peeps Im a right in thinking that the new I&E will need to be done cos this poster is not using a car anymore?

If this is the case then could the allowances for the car in his IVA (mot/petrol/service) be allowed to be kept n saved up to purchase another car in time. Or would a payment break be better till further employment found?

I haven't as yet but will do once this redundancy thing is all sorted. There is a chance I'll be offered a different role within the company but at a much lower rate, which I don't want to do. My case manager said I should advise her when I have all docs needed.

I'm still paying car insurance as I can't cancel it.

Hi Again,

Sound like your going to have to sit tight and see what happens with your job, I do hope it works out for you. Are you considering taking the lower position in your employment?
Just thinking if you did a new Income & Expenditure could be done & a meeting with your creditors could be arranged.
Regarding the Car - you really need to let them know, as even if you retain your job a payment break could be arranged for you to save for the car. Or if redundancy is on the cards some of the money may be able to be kept to purchase another one - hopefully.

I find it unethical that your IP wants a portion of your tiny redundancy package. It's plain wrong. There should be some provisions in the IVA agreements to prevent such measures.

Unfortunately pop, redundancy is classed as a windfall regardless of how large or small it is. You can normally retain enough to live on for a few months whilst you seek further employment.

It is not the IP who dictates this as far as I am aware, but the creditors.

They obviously want back as much as you can pay them.

Pop, although it might seem unfair, it's not unethical as it's part of the IVA agreement.
