Hi..received a 'notice of application of attachment of earnings order' yesterday for a payday loan for a whopping £700! Can anyone advise on how to best respond to this as it claims if i dont respond within 8 days they can contact my employer and/or send me to prison!
I've forwarded it on to DFD this morning requesting he rings me to discuss but as my creditors meeting isnt until the 13th March I'm after a bit of advice please

Hi Vimto,

Please don't panic at all - DFD should be able to deal with this.

Ignore the threat of prison, that's just bully boy tactics and shouldn't be allowed. They can contact your employer though as obviously the money would be taken directly from your wages.

Phone DFD as well and tell them to check their emails and get this sorted for you.

OMG never hears that one before, threatening prison is that even allowed???

"You must send the form back to the court within 8 days. It is an offence not to send back the form or to give false information. If you don't send back the N56 form the county court bailiffs will serve you with an order to fill it in. If you still don't contact the court then you will be sent a notice to go to a court hearing to explain why you have not given the court the information requested. You must go to this hearing. If you don't attend then the court can issue a warrant for you to be arrested and brought to court or even send you straight to prison.

You can be sent to prison for up to 14 days or fined simply for not following the court's instructions to fill in the form and go to the hearing.

Warning: if the creditor knows your employer's address the court can go directly to the employer and ask them to provide details of your earnings if you do not return the N56 form to the court."

You will NOT go to jail so don't worry on that score. DFD should be able to sort this without it becoming an issue. As worrying as it may look there really isn't anything to lose sleep over, you will be just fine.
Last Payment made 04/12/14. Completion Certificate 25/7/15. IVA company GT. No Issues

Thanks for all your comments people..still no word from DFD unfortunately..hopefully Declan will read this soon and help! Dont really want to fill it out with my employers details on and stuff if its going to be sorted through the IVA but then cant really ignore it either! All this is confusing!!
