my wife works for an estate agents that is owned by a building society and they are doing new credit searches? we have been in an IVA for 3 years and she is worried that she will loose her job? where do we stand?

If this has never been done before and isn't in her terms and conditions I wouldn't have thought they'd be allowed to do this, nor take any action on the results. Check with them under what authority they are acting and push the infringment of your human rights arguement if needed.

Does your wife belong to any union or association that might be able to advise ?

I would also suggest a visit to CAB
