hi
my son has been referred to the orthodonist because he has crooked teeth. unfortunately the grading is 1-5, 1 and 2 qualifying for nhs treatment, my son is grade 3 and therefore i will have to find the possible £1200-£2000 pounds (they have a monthy plan). is is possible to include this is our next I + E review or would it be excluded? my son will not be happy! thanks

I am an insolvency practitioner and I had a similar case a few months ago and I proposed a variation allowing them to save a given amount each month to pay for the dental treatment. The variation was approved by their creditors. You need to discss this with our Supervisor so they can establish whether such variation would still allow your IVA to be viable to your creditors.

The variation can be done two ways
1) A reduction of your monthly voluntary contributions
2) A payment holiday but extending the term of the IVA to allow you to make up these payments. eg if ou have a five months payment holiday then your arrangement would be extended by five months, assuming our IVA is over 60 months then your arrangement would be extended to 65 months.

In option 1 it may be also necessary that your IVA is extended to cover the reduced payments to ensure that you are maintaining the level of dividend offered.

You need to speak to your Supervisor and he will need copies of the estimated costs of the dental work and whether the work is necessary.

My daughter who is 13 has braces she was graded a 3 and has had hers fitted for free on nhs. She has to wear hers for 18 mths . So i dont know if its different areas that qualify for free braces,because that sounds an extreme amount to pay for braces.

maybe you should get in touch with the commissioning department of your Primary Care Trust to see if this is covered by NHS, I believe you can appeal and the case goes before a panel

Ithought if you missed three payments your iva would be in trouble???is this right or not i;m confused?

There should be no problem in getting support from your IP or the creditors providing your IVA has run satisfactorily to date. I would see how long you can span the instalment payments over and see if this can be budgeted within the IVA.

Most recently proposed IVAs have provision for the Supervisor to reduce your payments by up to 15% without seeking a formal variation, so check the terms and conditions of yours to see if you have this provision.
