letters rec'd this morning after IVA agreed

Good morning everyone,

My IVA was agreed on 22/12/07 and this morning have received 2 letters, 1 from a debt recovery company giving notice of intended litigation and another from a credit management company asking me to ring them.

I am not sure what to do with them. do i ring them to advise them that IVA agreed or just ingnore them?

Hi janot

I would call them and inform them that the IVA was agreed on the 22nd. These things take time to filter through to all departments. They will probably make a note on the file to hold any further action pending the information coming through. Some of my creditors asked me for the Court and Case number which will appear on your Chairmans Report. If you haven't received this yet tell them you will call with the information once you receive it. Legally you are now protected against any further action but the wheels move slowly at the best of times. Add Xmas into the mix and it grinds to a halt.

Don't worry about it but do give them a call out of courtesy.

Ring them to remind them that you have an IVA which is now agreed and that you do not intend to engage in any further correspondence with them. Get the full names of the people that you speak to for future reference.

These sort of letters may well continue to trickle through over the next couple of weeks, as creditor systems get updated - always a little slower at this time of year.

Hi janot

I got calls and letters for a couple of weeks after my iva was accepted, so don't worry there is nothing they can do.
IVA was approved in Nov and the post I got pre iva was everyday statements, letters, etc post iva I hardly get anything. It really has been dramatic and a welcome relief.

If you have any dealings with Goldfish/Morgan Stanley they continued to phone me until my name was showing on the insolvecy register which was a bit annoying as it was like they did not believe me...

If in doubt, forward them to your IP and let them deal with it - then they can fax the chairman's report, etc to the relevant people if necessary.

When i rang the Debt recovery company (Moorcroft debt recovery limited) the guy called steven told me that unless i sent him copies of everything in the post we would still get charges and extra interest added and that we will be liable regardless of the IVA is this true?

That's absolute rubbish - and the creditors who they are acting for has already had all of this information, so I suggest you suggest that they speak to their client.
