I completed my IVA last April after a F&F offer was accepted etc etc.
All going well and every company has updated my credit reference files accordingly with the exception of Santander (who ironically I have never had a direct account with-was a Cahoot loan and I'm told Santander took them over)
I have written to them to ask them to correctly update the information and sent the completion certificate as well on 3 occassions including to their data commisioner as well.
They will still not update the credit files properly and every month they place a new default on my account.
I get passed from customer services, back to collections and then on to complaints etc etc. I have written and explained the account is satisfied on so many occassions it is ridiculous.
I'm now at the end of my tether with them and was wondering if anyone has any advice about taking legal action against them or if anyone has gone down this road before? Please don't advise me to go to CAB-chocolate and teapot spring to mind!

hi robolots ive had the same treatment from santander and have done the same as you in the past to no avail.what i have been told by credit agency is the balance and default will drop off once the six years is up from the start of my iva even though i completed mine with a F&F offer.
You should be able to escalate this to the Information Commissioner I think it is - they'll hopefully sort something for you.

Has he? I thought he'd just contacted the Data Controller at Santander and tried to go through their complaints department.

Possibly, but I'm inclined to think that it could be the data controller at Santander. I do stand to be corrected though.
The ICO should take things further.

Wow !! well what the credit agency told me was correct,ive just updated my annual credit report and all my ex creditors have dropped off my report is as clean as a whistle,i,m really chuffed about that.i know i need to check the other agencies,but after the 6 years your records are clean.
I read that the OP has contacted the data controller at Santander and not the ICO. If the data controller isn't co-operating you need to contact the ICO as they will force them to comply.
