My girlfriend has just started her IVA. Basically her out goings are £110 more than her incomings and it doesnt look like her IVA rep who arranged it has given her adequate allowances for clothing etc for her two children. Is there anything she can do about this? She is thinking seriously about bankruptcy.
Hey united, welcome to the forum, Has your girlfriend's circumstances changed at all since the start of the IVA or do you think that the payments were set too high from the offset? If you can post a few more details, we can try and help. X
Hiya and welcome. She need to contact her ip asap regarding her allowances. If she is struggling now, maybe she would probably not last long in an IVA and might be better off filing br.
Does she have any assets, house/car etc which may be lost in br?
I think it was set too high to be honest, she doesnt go out and spend much. She gets little to no help from her ex husband who left her in this mess.
The person dealing with her IVA is pushing for a Debt Management Program because he doesnt want her to go bankrupt as he wont get anything out of it. He does little to help her and she still gets calls from people she owed money too.
She has an old car worth £500 tops! rents her house privately. She really doesnt know what to do for the best. Ive offered to help out with money etc but it just looks like she will be really scraping about for every penny for the next 5 years.
By rights your G'friend should have been given advice and information on all of the options available to here, DMP/IVA & BR.
This way she would have been able to make an informed decision. I know that the allowances are quite tight in an IVA but they have to be realistic and workable or the IVA is doomed to fail. Was she advised about all of her options?

I agree with Chris, our IP went through every option (they advised br actually) but we really wanted to try and pay back some of what we owe and so went for the IVA. They gave us £60 per month for clothing and shoes. I have two under two and they grow fast and that is enough for me to kit them out in stuff from Asda and Tesco! I do get shoes from Clarks though as I won't skimp when it comes to their growing feet!
Charity shops have some great stuff as do dress exchanges..there is a fab one near me where I can pick up last seasons Next, Pumpkin Patch and Baby Gap for about £2.50 per item. Bargain!
eBay has loads of stuff too!
Can she not try these options??? If not then yes, ring the IP as this will need addressing.
Im not sure how much or how well she was advised and im not too impressed with her IP. She is maybe partly to blame, she knows its a tight deadline but surely she should be left with zero at the end of the month and not more debt.
Her housekeeping is £320 and there is nothing in there for clothing. No emergency allowance for birthdays etc.
She does get most of her kids clothes from tesco asda etc.
Hi
I've already looked at your sister site (BR) and logged on there.
My IP did explain DMP to me in the first instance but he didn't think that it would be right for me as it would take so long and no guarantee that interest could be frozen etc. So looked at both IVA and BR. I wasn't keen at all for the BR and he was saying that IVA is probably a better option for me.
At the time i didn't really have anyone to talk to apart from him about it all and just thought that he's the expert so it'll be alright. I do remember when doing the incomings and outgoings that we discussed clothing, hairdressing etc. And he did day that ideally i should be paying £229 but could only do £219 and he said they could probably do something with their fees so that could be sorted. I got everything through the post and obviously didn't check things properly as there is no mention of a budget for clothing, kids activities, etc. Also since discussing this my rent, council tax and water rates have each gone up by £10 each so that's another £30 i'm down.
The only reason that i didn't really realise was because i had a compensation payout which i've been using to subsidise which is obviously not going to last forever.
Thanks to everyone as i have found this site really useful and found out things that i hadn't even thought about.

From what you are saying I think that bankruptcy would probably be a better option for you. If your allowance has not included any provision for clothing or expenditure related to the children, then it may be unlikely that you would actually pay anything under bankruptcy proceedings, and you could begin to put this all behind you.
Hi melanie
I've come to the same conclusion that bankruptcy really is the best option at the present time. Just a shame that i've found out that i have to wait three months for my IVA to fail before I can go ahead. At least there's a little bit of light at the end of the tunnel
Thanks for the advice so far.
