Just wondering whether fines from unpaid parking tickets would be included in an IVA ?

hi there I just popped out and returned after picking daughter up from school to find TAKE FORMAL NOTICE
THEY ARE IN POSSESSION OF AN ENFORCEMENT ORDER ISSUED ON AUTHORITY OF THE TRAFFIC ENFORCEMENT CENTRE AT COUNTY COURT BUSINESS CENTRE
now I'm worried. please help

This is what bailiffs are allowed to do but it is totally different to debt collectors.

I realise that but can they be included in the iva.

Bailiffs have to have a high court order. I really think they are trying to frighten you - exactly what does that order say? Does it say they can come in?

we as certificated enforcement agents are in possession of an enforcement order issued on the authority of the traffic centre at the county court business centre for an unpaid penalty charge notice.
take notice I have attended today to arrange removal to auction of your goods vehicle to recover the sum due.
we were unable to make legal entry or locate your vehicle and will now continue to visit your premises on a regular basis to take control of your goods

For the avoidance of doubt, these debts CAN be included in an IVA, if it is the right solution for you. They cannot be included in a DMP, but can also be included in a DRO or a full blown Bankruptcy. Run a mile from anyone who suggests that they cannot.

Before that though, they could potentially levy on the car as a means of raising funds to pay the debt with. They tend not to do this if it is of low value. If of higher value, then it is a good idea to park the car on private land, not your own drive or the public highway.

To assist further, can you confirm how much your total debt level is, how much the car is worth and whether you have any other assets, such as property?

my total debt level is around 9k also my car is worth about £400 no other assets also I'm on dla and eesa

Because they cannot make entry to your property makes me wonder whether they have a high court writ. Agree with Size5 that you should arrange to move the car to another address so they cannot access it whilst you sort this out.

Speak to a debt company immediately that can help you out.

I doubt they would take your car at that value - it's not worth it for them.

I hate people like this - they are putting the frighetners on people so they will cough up.

The other thing is to contact the County Court and see if you can make a repayment plan with them for the parking fines.

this is what I'm trying to do also get an IVA but the company I spoke to yesterday called me yesterday evening and told me they couldn't include the parking tickets
I'm been informed on here they can I'm CONFUSED

If £9k is your total debt then look at a DRO if you have less than £50 a month DI after normal bills have been taken care of.

It will cost you £90 a month and then possible payments for 12 months and then that is it.

These debts are not actually fines, they are penalty tickets. It is 99% certain they are not interested in your car so it should be safe wherever you park it, however to be on the safe side can you park it on a neighbours or family members drive?

From what you say, an IVA isn't the right solution for you, you need a Debt Relief Order (DRO) which is often described as a mini bankruptcy. Providing you meet the qualifying criteria then you will pay a one off fee of £90 (can be paid in instalments if necessary, but the £90 must be paid in full before you apply) and your whole £9k debt will be gone, including the penalty notices, and therefore the bailiffs chasing you.

I know you all have experience of dealing with this type of problem and without causing trouble is there a company that would except my circumstances and would include these tickets with the IVA.
the company that I was asking advice from is still saying they cant include them

Which company had you contacted?

There are a lot that will do a DRO which does sound a better solution for you.

the company I was talking to was debt navigator based in Scotland but offices in different locations
