IVA transferred to GT. Got letter today saying IVA has failed. Any help from anyone please ?

in an iva since jan 2010 transferred to grant thornton got letter today saying iva has failed. they have been paid dd every month and when i rang said that it wasnt enough money!!! asked if we got this back said it had gone to creditors but had rang creditors earlier who said hadnt recieved any as yet then grant thornton changed story to say it didnt work for nothing and our money nearly £5000 up to now has gone on fees . this from our debts which were £16.000. who do we get to investigate this please as they have tool our money and not done what the iva was set up to do with it. any help from anyone please .

Have you pad across all payments that were expected Jacqui? have you earned over and above your base income and paid any extra across that was expected? have you previously received a letter to say you were in breach? this all seems a bit strange to come out of the blue without any warning from GT

Hi and welcome

Have you been paying the agreed amount each month or a reduced amount ?

If the IVA has failed it is quite normal for the Insolvency Practitioner to take their fees

I echo what has been said above. However, it IS quite strange to get a failure out of the blue. Normally you would be notified of a breach and given the opportunity to rectify this.

Does the letter state the IVA has failed, or does it say you are in breach ?

I suggest you drop Karol a line on IVACustomerServices@uk.gt.com putting only "IVA Forum" in the subject line. She is very helpful and I am sure she can explain.

Why has your IVA failed, Jacquie? I assume you have failed to make three or more payments to date?

hi foggy sorry didnt reply on friday . got in touch with karol at grant thornton and she sent me an email saying they responded accordingly.? but nothing else should i get back in touch again as this didnt really answe my email to her. thank you for your help giving me the link to karol.

hi melanie thank you for getting back in touch. we havnt missed any payments to grant thornton. they get paid direct debit same day every month. sent them everything needed for annual review for end of last year then heard nothing back from them so presumed everything was ok. then couple months later got a letter saying we were in breach so had a variation meeting i think thats what they call it for an hour on the phone and had to send in further payslips and statemnets as they claimed not to have recived the annual ones but if they hadnt why didnt they get in touch? anyway sent what was needed after variation and heard nothing so presumed everything ok only contact had was them asking our permission to go ahead with ppi claims which we were pestered about a lot. then out of the blue the letter on friday saying our direct debit had been suspended which is why i got in touch to be told iva had failed. to add to this on saturday they had sent out further letter asking for documentation for our next annual review what are they up to? wanted to know really can we get in touch with ombudsman or fsa or make an appontment with solictor please help . many thanks jacqui xxx

hi jerry lee. got reply from karol who said they would respond accordingly and that is all i have heard up to now. just wanting to get as much advice and help from anyone else who has dealt with grant thornton so we know what to do next as if they have failed iva do we get in touch with creditors ourselves and try to wrk out debts ???? xxx jacqui

Hi jacqui.ml can i ask a question please as this post really interests me for reasons and concerns over my own iva .. how did GT take it that you had contacted the creditors yourself ? And what were your concerns as to why you did phone the creditors ?? Hope you dont mind me asking . Ty x

So Karol posted on here saying she has responded accordingly by email but all the email actually said was that she has responded accordingly? Have I got that right?

Hmm -- there seem to be a few crossed wires here. I would reply to Karol asking again for an explanation. If she is anything like me she might have meant to add an attached file to the email and forgot !!!!
