HI EVERYONE.

I am new to the IVA journey and am very aprehensive to say the least. I have been with the CCCS since February 2006 becasuse of lilited income a DMP was the best option at the time for me. However my finances have improved enough for me to apply for an IVA. However I have two CCJS, both I have applied for re-determination. The first ccj was from Land of leather who wanted me to pay more than my DMP. I have my hearing in September which I am so scared to attend but I know I must. The other one is with the Alliance and Leiceter their judgement was a reasonable amount but CCCS have advised me to send redertmination for that which I have posted today. A/L have said they may put a charging order would they do this only if i miss a court installmet or could they do it now I have asked for a redermination?
I just hope and pray that my IVA will be approved I have 38,000 debt Alliance and Leicester have the most 15800 approx. All my other creditor have been fine on the DMP ONLY THE ABOVE have caused problems.
I have got to get letters form my credtiors but some dont seem to want to reply will this affect my IVA also my salary goes up in Septemebr should I send in all the documents then which reflects my new salary or send old payslips with my old salary???

Any advice would be kindly appreciated,
Kind regards
Millie

When is your creditors meeting? Soon, I hope.

Storm will be around to give you advice on the Court processes, as he is more of an expert in this field than I. Personally I would be pressing your IP to complete your IVA as soon as possible, if there is a threat of charging order action.

Why is it taking so long? Are you using the same company that is currently managing your DMP - and by the way it is interesting to note that you are subject to ongoing legal action whilst in a DMP - yet further evidence of the uncertaintly afforded by these types of agreement.

I think that is taking so long because of me as I have.nt got all the information ready eg, I am awaiting for recent statements from my creditors to send in. I am with the CCCS who are very nre to IVAS. I am so scared of the legal stuff it is vey unsettling, I did think i would be protected in a DMP

If you are in a DMP with CCCS, they should have all of this information readily to hand, as how else do they keep tabs on how much you have paid off your accounts? Don't mean to be critical, but you have ongoing legal action being taken against you here, so you do need to move as fast as you can.

Millie

Just as a matter of interest, how have you found CCCS to deal with? Are they approachable? Do they act on matters quickly? And have you felt comfortable with their advice?
