Dear All,
I have sought the answer to this question but do not seem to obtain a concrete answer. Hope someone can help me :
I began an IVA last year in July. At the time, I was in full time employment. I was paying £500.00 p/m over 5 years. However, a few months before this I was feeling very tired very easily and put it down to diabetes [ I am insulin dependent ].However, it got worse and I found that I had cirrhosis of the liver and suddenly, I suffered from muscle wastage in my legs which caused great discomfort and pain. Since then [ now a year ],I have not improved and am now on benefits . I explained this to the IVA Manager and did not pay for 4 months. He then suggested that I should apply for bankrupsy. Is this right? Recent medical examinations revealed that there is very little chance of me working again. I cannot walk without a stick and have great mobility difficulties. I am still paying the IVA [ started 3 months ago ], using a combination of benefits, assistance from a friend staying with me and help from my sister. Can anyone advise me on alternative solutons ? I would be grateful. Carlos

Hi Amena and welcome to the forum. So sorry to hear about your poor health.

I think your IVA company are right about bankruptcy proceedings. There is no point in continuing to pay contributions you cannot afford, and the money you do have available is better spent on looking after yourself.

As you are on benefits, you ought to be able to petition for just £185 - so I would download the application forms from the Insolvency Service' website and read through them carefully. Soon you will be able to put all this behind you.
