IVA ACCEPTED - Not all good news....

Hi everybody.

I'm glad to say my initial failed submission has been revoked and my IVA has now been accepted! It's been running smoothly for 3 months now.

However, I have run into a little problem. I had a mobile phone contract that I hadn't been using (mainly because of creditors calls) and I completely didn't take it into consideration when starting my IVA. When I closed my old bank account it stopped being paid for, and that was the last time I gave it any thought.

Out of the blue I've received two letters from a debt collection company and a solicitors asking for £320, and If I do not pay, I will be taken to court.

What would peoples advice be? At the moment, I am considering selling my TV and/or my laptop to pay for it. Would this be something my IVA Supervisor be able to deal with, or is that going to cause even more trouble?

The solicitors kindly suggest using a credit card to pay the debt management company :-), I couldn't help but laugh at that...

Doing research on the internet it seems others that owe money to them have setup a payment plan to pay them back, however if I did this, would it be in breach of my IVA?

Sorry about spellos and bad grammar, I've rushed this through as they are suggesting I have 48hrs to contact them before they start court proceedings, which seems somewhat unfair considering it's nearing the weekend and they probably will not be contactable...

Excellent news James!

You need to speak to your IP about your phone contract and I am sure it can be included.

You should not pay this company outside of the IVA as it is preferring one creditor over all the rest.

It will take a while for a debt collector to take you to court. Speak to your IP as soon as possible and they will sort it out for you.

I guessed this probably would be the most sensible route to go down.

Just hope it doesn't cause much trouble, it felt so good the past few months, the worry had lifted.

I last paid a phone bill in November I think, so I guess it has been a while..

IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Not a bad thing to keep a mobile contract going as it can show positively on an otherwise shabby credit file. Did you want to keep the contrsct going or has it now been cancelled anyway?
