Is Payplan paying my creditors

Hello all,

I am a newbie to the forum, so hello to everyone :O)

I started an IVA with Payplan in September and apart from getting letters from some creditors saying that I need you make a payment which payplan have told me to ignore, everything seems to be going to plan. That is until this morning when I received a very rude phone call from Simply Be asking why I haven't been paying my account. I explained that I was in an IVA, but she accused me of lying as they haven't received any notification or payments from Payplan. I am now worried that I have been paying my monthly payments for 4 months, so surely they should have been paid something by now?

Hi and welcome.

I wouldn't worry about this at all. This is a call centre and they are just trying to bully you into paying money. They may not have been paid at the moment - it takes a while for payments to go through as I believe fees are taken first.

You are protected by the IVA and if they call again, point them in the direction of the Insolvency Register.

Email your case worker at Payplan although you won't get a reply until after the new year.

Hello and welcome. Some of the operators at these call centres don't even know what an IVA is ! There is every chance that none of your creditors have yet been paid anything. Some IP's make payments quarterly, 6 monthly or even anually, depending on what was agreed at the meeting.

Ignore the cll centres as well as the letters, they are bound by the IVA whether they like it or not.

Welocme to the forum.

Politely tell them to get lost if they are rude. You are fully covered as the others have said. I know that my IP keeps the 1st 5 payments as part of their fee so maybe this has happened in your case.

Either way - ignore them and have a good Xmas.

One of the modiflication of my iva was.
the nominee fee will be equivalent to the 5 first 5 monthly payments.
the 1st dividend shall be paid to creditors 3 months after that.
So it could be 8 months before creditors get there 1st payment.
IVA now over with and it was worth it.
now starting my life again,

Thank you all, I will just ignore them as I have just checked my paperwork and yep they are listed on the IVA. So nice of them to phone at 8:30am on Christmas Eve to try and spoil my celebrations! Anyway, I wasn't rude just stearn and to the point.

You wonder how they can do things like that at this time of year don't you?

At least you can safely ignore them and enjoy Christmas.

Hello all, hope you all had a nice Christmas.

Well, I have had yet another call today from Simply Be demanding that I make a payment. I explained about the IVA again, but it turns out that when I checked the paperwork from payplan the company that is listed as owning Simply Be is wrong, as so in fact they do know nothing about my IVA what so ever! Still can't inderstand why it has taken 5 months for them to start calling to ask questions about payments?!?

I have explained that Payplan IVA team are closed until the New Year and I cannot do anything until then, but will contact them 1st thing on 3rd January. That wasn't good enough for Simply Be who said that wasn't good enough and I will ne getting a phone call every day until I make a payment. I have never been rude, just firm and polite but they don't care that I am telling the truth.

I wish comapnies like this would stop bullying us folk who are trying to get themselves sorted out financially and trying our best to enjoy the festive break with family.

It is annoying, I agree. What's even more annoying is the fact that Payplan, like a lot of companies, simply shut down for the whole of the Christmas period. It would be better if they opened inbetween Christmas and New Year. This is the the time of year that a lot of people need to get in touch.

Drop your case officer an email so that he/she knows about it before you call.

As for Simply Be, just refuse to.enter into any conversation with them. Just tell them it will be sorted next week and then put the phone down.

I agree with Jan - just put the phone down on them. YOu are protected and do not need to get upset or be hassled anymore. Which company did they put them down as? They are part of the ambrose wilson group I believe (as per my fashion world account).

When they ring don't hang up on them .... place the handset next to a radio and let them listen to Radio One for as long as they wish to pay for the call.

Ha ha, love the radio idea :O)

They have put them down as being part of the Shop Direct finance group when in fact after doing some googling I found that they are owned by the N Brown Group.

I agree that Payplan should be open during Xmas, although I do have to point out that the helplines for new customers is open, just the exisiting IVA line that isn't.

I know they have the one open for new enquiries but I hate the fact that those of us in an IVA can't get hold of anyone, especially if its an emergency.

Have you checked payplan plus to see if they are listed as a creditor with account details? Simply Be are part of shop direct? Who do sell debt to TTI I think so may be listed under this.
The road is 72months long starting September 2010.

Different companies can show up as rather obscure names so don't panic. Next time they phone warn them you are recording the call for your protection and tell them you are in an iva and give them your ip's details. They can't harm you and have a job to do although I wonder how them being rude ever gets someone to make a payment!
