Is a referral bonus treated as a commission payment or a windfall ?

Hello! I've had a quick look, but I cant seem to find the answer to this one!
I'm 3 years into an IVA, I work full time and also earn a commission, which I split with the IVA, so I understand that.

My firm offers an Employee Referral Bonus for referring a friend to come and work here. So, this is what I have done and now, my friend has been offered the position - yay for me!

Thing is - how do you treat a referral bonus? As far as I'm concerned, I've earned it because I was the one who got all the info, talked to the person advertising the position and basically acted like an employment agent!

It's for £600, it'll be paid through my wages so will be subject to tax and NI and of course show on my payslip and on my P60.

Do I treat this as a commission payment? Or do they class this as a windfall? I'm praying this is classed as commission!!

I think that you could successfully argue that it could be either. If I were acting for you, I would probably go for the option which allowed you to retain as much of the money as you could - but you will really need to clarify this with your own IP to be sure.

As I can see its paid with yr wages. So you keep 50%? Good for you
