IP has called me to say are cancelling my IVA

I have been in an IVA for 2 and a half years. Last year I earned considerably more than my first year and was asked to increase my monthly payments. As my results at work had then decreased I said I could not commit to higher payments, but would try to contribute to the extra they were asking for. I have now changed my employer and earning much less (approx what I was originally assessed on) but my IP has called me to say because I have not paid any extra they are cancelling my IVA. I have always made the original monthly payments. What will happen now, and can they do this?

I canot see why your IP would want to fail an iva when you have at least made all of the proposed payments and are willing to make up the extra you should have paid, speak to them again and ask why they want to fail it when at least the original dividend is being paid.

What comes out from your post is a lack of communication with your supervisor.

In your IVA you probably only have a responsibilty to pay in the original contribution that was set, rising only where the IP is satisfied that you can afford an increase.

It sounds as though you have given him information that indicates that you could afford an increase but then failed to tell him that your circumstances have taken a cahnge for the worse. Result, he still thinks that you can pay the higher amount.

Reading between the lines, talk of cancelling the IVA suggests that you have left this rather late but I would think there is till time to resolve this, if you have been able to make the original payments, but you must talk to your supervisor urgently.

This seems harsh,but as Catullus states it seems like a communication problem.
Take time out and arrange a face to face meeting with your IP and try and salvage the situation.If your IVA fails you will be back to square one or possibly made bankrupt.

I have written & e mailed my supervisor today, as no one replied to my phonecalls yesterday. I have asked for an explanation and possibly a meeting. I did inform them when I changed employer and my wages dropped. I have had nothing in writing to inform me of their intention to cancel my IVA. I will see if I get a reply.
