in order to apply for an iva, as a married couple to both parties have to work,

Hi there freakles and a warm welcome to the forum

Not necessarily - for instance if one is a homemaker or parent looking after small children, then that should be perfectly acceptable to creditors. Do both of you have unsecured debts?

yes both of us have debts and my youngest is school age so does that mean i do not qualify for an IVA,

No - but creditors will want to understand why you are not working. Would you consider a part-time job around school hours, and if so would you really need an IVA at all?
