HELLO
i need your help! I am in my second year of paying my IVA, I pay 400 a month of a 20k debt, My Nominee has now wrote to me saying that they want to up my limit to 500 a month, I cannot afford this I have 2 jobs and just about can keep everything to gether, any ideas on how I can stop this happining? Also how does settling my Iva work? I think Maybe this will be an option aswell? Please Help

Hi, I would just submit a new Income and Expenditure form putting down exactly what you pay out so they do not increase your payments. Obviously if there is any surplus it is only fair they increase your payments but again it does depend on your circumstances

Hi Gucci - have they said why the increase? Does it follow a review?

You need to contact the IP and find out why the increase and explain you can't pay. In my experience it is easier to contact by phone ASAP -saves a lot of worrying.

Forgive my maths but, from what you say the payments to which you are already committed (£24k) exceed the total of your debt. Has the Supervisor told you why an increase is justified?

It is rather unfair to expect you to increase your payments when you are reliant upon two jobs in order to meet the basic payments - but in reality if your IP is following the proposal to the letter he can hardly be criticised. As Ray has advised, you ought to complete a new income and expenditure form to ensure that you can demonstrate the that requested increase is not viable.

Hello and Thanks for your advise

My boyfriend has just looked throught my contract and my actual debt at the start of my iva was 17900k not 20k as I previously thought, and Im paying £400 a month.

I have just sent my IP my bank statements and Payslips for the last 6 months as requested and he sent me a letter back and said you can afford another £100 so please complete the direct debit form and return asap!!! ( im not joking)it was as simple as that!

I filled out an new Income and Expenditure form when I sent all my paperwork and I even sent documents to back my Expenditure.
I called my IP and was told he is out on business and I would have to wait a week to talk to him.

I have heard alot of members talk about seattling there iva early and I think I may look into this? any advise on this? is there a certain amount I have to offer for my credditors to accept?

I am in the process of writing a letter back to him there is no other way to get hold of him until next tuesday!

Surely there is someone else you can speak to! Doesn't he have a Manager, Office Manager or do you have a Case Manager? Waiting a week to have a telephone chat is hardly acceptable.

I'm no expert but it seems to me you are paying back in full what you owe plus about £7000 over the top to the IVA peeps. An increase does not seem warranted and I would really push to speak to someone as soon as possible.

I know you would think there would be someone else but apparently he is the only one who I can talk to and today they have told me he is the only one who has my paperwork!!

I assume he has a large briefcase which he carries around all his clients paperwork in!! What a lot of nonsense,your file will be easily accessable.What happens if your Ip was to disappear off the planet,would there be no record of your IVA at the company???

A debt management may have been better for you at the time,I am surprised that your creditors accepted an IVA over this option.
What company are you with ?

FINALLY I have received a letter!!

ok there saying for a 17900k debt that I started off with I have been in the iva for 1 year and 9 months my seattlement figyre is 14k!! what do we all think of that???? i was thinking about 10k? :-/
can I offer lower?
