I hope you can help me I am at my wits end. I have had a iva for the past 18 months and I must say I have found it difficult to keep up with my payments. I was given until the 27 Feb to bring the payment up to date, I wrote to my supervisor on 25 Feb to say that I had paid in a cheque and was waiting for it to clear so on the 28 Feb I paid £1,300 in my iva account and I was going to pay the remainder £350 by this week.

On the 28 Feb when I got home from work I got a letter from my supervisor to say she had instructed her solicitor to make me bankrupt. I wrote to her again to say that I would lose everything my husband, my job, my house my father has a bad heart and not sure he can take all this but she just said that I would hear from her solicitor. I will up to date on Friday, is there anything I can do.

Last September when I was having problems I went to see her but she didn't give me any support all she kept saying was why don't you just throw in the towel and go bankrupt!! Thank you

Hi ther and welcome.
This sounds very unfair, if you have caught up with the payments I see no reason to continue to force bankrupcy. I would ring again and ask why she wants to continue the bankrupcy when you have in effect caught up.

Thanks for your reply, I did write to her again on Saturday after she wrote to say that I would be hearing from her solicitors in due course. Do you think if I am up to date and pay March's payment at the end of the month the court will still make me bankrupt?

Hi Dawn I am not a technical expert so cannot answer definatively, I would if I was a judge be asking why when you have made the effort and caught up. Can you not telephone her and speak to her.

Hi Ang, when I wrote to her after I received her first letter last week to say she was instructing her solicitor she wrote back and said that she had already instructed her solicitor but would still accept my money!!! I wrote back to her on saturday but she has never replied to that letter. There is no point in ringing her she only likes to be contacted by letter. I did try once by email and she wasn't very happy. Not a very supportive supervisor. But thank you for replying to me it has helped me very much.

If your IVA is upto date then I can't understand why your IP wants to proceed with bankruptcy.
Go and see her again and try and get this sorted out.

Hi,

The reason is because she gave me up to 27 Feb to pay back the arrears but I couldn't do that until the next day when I knew the money was in the account. I did write to her but she wouldn't listen. I think it is because I have been behind before but I have always made sure I am up to date by the date she has gave me. All I can do now is wait and see. I am so worried I will lose everything if she has her way and I have to be made bankrupt. Thanks for your reply.

Hi Dawn ... this sounds very unfair to me ... Like Andy I can't see why, if you have paid up to date, they should want to make you bankrupt ... surely it is in the IPs interest to keep the IVA going if at all possible so that they collect their fees?

Which company are you with Dawn? Sometimes it helps to name and shame. I believe that quite a lot of IPs look in on this Forum which has earned itself a good reputation over the time it has been established.

Just wanted you to know that we are all rooting for you Dawn.

Yes I would also like to know which insensitive person you have acting for you as well. Why do professionals have to act like this - and do they honestly believe they are acting in the best interests of creditors?

Many thanks for everyone who has replied to me this evening. It has really helped me it is surprising I always thought it was my fault and I was so frightened to say anything to my supervisor. Last november I was having problems and I actually broke down and told a friend of mine, I was getting really confused with how much I owed, i thought it was about £650 after a lot of confusing emails with my supervisor, it worked out it was £1,650 I showed my friend the emails and she was so shocked in my supervisor's reponses she was so rude. There are so many other things I could tell you I would be here all night going on and on so I think it would be a good idea if I went to bed now. I will be in touch tomorrow and will let you know the company that I am using. Many thanks again everyone, I feel a bit better tonight I might even have a good night sleep.
