I have received a PPI claim. Please could someone put my mind at rest ?

I have 11 months to go before completing an Iva and today I have received a PPI Claim please could someone put my mind at rest- my IVA is with Debt free Direct.

a. I never took PPI out so do I need to fill in the paperwork

b. Will this cause delay with the completion certificate when I have completed in March?

Hi,

You may have ppi you don't know about...one poster has already benefited from this! So it's worht filling the forms in.

With 11 months to go, I wouldn't be too worried about it holding up your completion. There should be plenty of time to process an investistn and claim. They take about 3 months apparently.

You've got nothing to lose by going for it.

Hi and welcome.

If you definitely didn't take any out then I would let DFD know this otherwise, as BOL says, you can always sign the forms and send them back. It shouldn't delay things at the end.

The thing is, there are people out there who have PPI without knowing it. So why not send the forms back to let the company investigate and put a note on the forms that you don't think you have any. It doesn't cost you anything.

I don't dispute that and I did say that the OP could fill the forms in as it shouldn't delay completion with almost a year to go.

If you can prove you didn't have PPI from your original loan agreements etc then there shouldn't be a problem, however I'm assuming like most we assume PPI was not taken out but not 100% sure! Simple answer either way you'll probably be doing them before completion, either now or after your final payment! Better now in good time, that was all complaints and investigations can be done before completion date!

I think the biggest problem with this PPI thing is that it is being dropped on many who are, literally, days away from ending their "sentence" and threatening to prolong the agony.

I am lucky in that my lot have just written to me with forms of Authority to Act and I have years to go, so they can waste their time if they so wish .... you never know, they might get a few quid, but I doubt it.

Whilst I realise that IP's have a duty to maximise the return to the creditors, they also have a duty of care to the client and this sort of move at such a late date is not an acceptable way to treat clients who have, otherwise, bent over backwards and fulfilled their obligations.

I feel that the responsible IP should make the call that, where a PPI claim would extend the effective term, or unduly delay completion, then, tough luck to the creditots, it has been left too late and should not be pursued. The creditors have been missing this particular trick for years now, so they should accept that they will miss a few more claims for a short period.

I think the difficulty here is that the IP's duty to maximise returns and realise assets are explicit in the proposals, whereas the duty of care to clients is much more fuzzy. So IPs don't really have a leg to stand on when creditors start clamouring for ppi claims. [:(!]

Having been on the forum now for over four years, I can't believe the way things have changed.

It used to be that you did your five years (rarely was there an extension) and got your completion letter.

Now 6 year IVA's are becoming regular, equity release is always there even though none of us are likely to be able to get funding and with the VAT and PPI claims it is very, very stressful.

I wonder what the next thing to come along will be?

....if you've had a PIP implant there might be money coming your way. I have already started to get "Can you claim" emails. I wonder when the creditors will pick up on this!

Will it be a defence that I am male and my moobs were always big enough, thank you :-)

I agree Jan it seems these days that nothing is simple as it first seems and especially as the fiscal problems of many now are increasing, added to that now being harder than ever to get mortgages even for those with excellent credit, hey ho hopefully these goal posts will one day stop moving. x

The moving goalposts are the most unsettling thing for me at the moment. Even down to whether my insurance company will allow me to renew my insurance on a monthly basis...aaagghh!
