I have had my IVA since November 2009. Recently, i have made smaller payments each month as partner got made redundant. My usual monthly payment is £185. We are currently running 2 cars and am going to sell one. I will give most of the money to the IVA;since im obliged to do so anyway under my IVA terms. I have been refused a payment break by my IVA advisor and am due to go on maternity leave in March. As yet, my partner is still not working and im very worrried how we will cope as I will be living off maternity pay. My IVA advisor said previously that my IP MAY allow me to pay money in from my car sale and take a payment holiday but now he is saying that this is not possible at all and I must keep up my payments of £185 per month! We have recently undertaken a new income and expenditure form which gave me just £155 per month surplus. Im not sure where to turn, my advisor tells me my IVA will fail if I do not keep up payments. He has advised me to go to the CRB. I feel he has been very rude about this and with my partner not working, this has just added so much more stress onto my life!

Hi there Emily

Sorry to hear about your situation. Are you and your partner homeowners or do you rent? I ask because if you are renting, one option may be for you to consider letting your IVA fail and declaring bankrupty. If you have that option, then the threat of suggesting it to your IP might get them to take a more serious look at trying to help you find a sensible solution so you can carry on with your IVA.

Hi - congratulations on the baby! And I'm sorry to hear about the rest of it. Ask to speak directly to your ip for clarification on what is and is not allowed under the terms of yur proposal.
