I have a loan with a family member

Morning all,

I had a call last night from an IVA company. She said that she would look into this issue for me.

She said that unfortunately I cannot be seen to be treating certain debtors (sorry not sure of technical words!) as priority and that the loan with the family member would be reviewed as all of the other debts/arrears!

I am starting to think that this is going to be messier than I realised, and I think i'm going to have to admit defeat, I can't let family down, this is a time when I need thier support the most [:(]

Morning adella,

Not all IVAs are straight forward, many are quite complicated, we are still waiting to see one of our experts views on this. If you go to the "about" section at the top of the page cluck & scroll down, you can see some of the firms that support this forum. I think I would certainly call a few more or even one on the forum. We normally advise everyone whom post to ring a few just so you get a range of views.

Don't give up just yet, I'm sure there will be a solution x

Thanks I will definitely keep ringing around.

It's such a difficult situation because I refuse for anyone to force me not to pay it, she's my partners mother and I really don't want to fall out with her let alone any family member!!! worried worried!

I am going to get my thinking cap on and start researching again

I know it's difficult & you do have to look at the whole picture, if you do nothing about your debts, can you still live and be able to pay them. Also think about how long it's going to take to pay them without getting further into debt.
Debt is a vicious cycle & once its rolling & lost control, its very difficult to stop it.

I am positive a solution can be found for you, we do know how your feeling & we are always here to support you.

In my current circumstances are happily affording all the bills, council tax, and the loan off my partners mum, we get by, even though it's tight - but hey doesn't everyone right!?

I haven't had my property repossessed just yet, but the repossession order will be given on 1st most likely.
It's the shortfall of the property that worries me the most, the extra outgoings would mean we would be in serious trouble, there is no room for me to make any further payments each month!

I suppose my worries are my family I don't want to lose everything I have, my partner is very supportive, but very frustrated that my ex has left me in this situation.

It was my own fault for being so trust worthy I guess! I have been told it serves me right on numerous occasions and I can't help feeling guilty that i'm dragging everyone else into my problems!

Working full time and trying to find time to get this resolved is stressing me out!

and breath - haha !!

I really do appreciate everyone's help and I am constantly looking for a solution.

There are so many out there just like you that have bern in similar situations & Been left to deal with the mess after a break up. You sound like you have a really supportive loving family & I'm sure they will stand by you.

Just reading what your going through, there will be a solution & you need a good IP to support you in this & take the strain off you. Hang on in there Hun x

Hi Adella.
There will be a way around this for you I am sure. You must concentrate on your own little family and try to do what is best for you right now. What does your partner think? Is speaking to his Mum about all of this an option?

I just wish someone could answer my questions about that loan, it's all I dream about, each expert I speak to says that are not sure!

I have just thought of another doubt in my mind.
I know that recently my ex took a loan out, im not sure how much for exactly, this was word of mouth from his mum.

How can I find out if it was secured against the property, I know that legally he shouldn't be able to do this without my signature, I could do without more hassle haha!

Don't apologise Adella! You want answers to your questions - we've all needed that support in the past!

If the ex took out a loan it could only have been in his name and I doubt he could have done a joint one. If he did, he is guilty of fraud and would be in serious trouble.
