Hi all Sorry i couldn't come back on t he forum earlier, I did ask a question about PPI claim and money directly taken by the Creditors and nothing to me, except the bill to pay to the claiming company. I have to pay 295 of 1990 pound to them and I cannot do it. I did inform my IVA company prior to start the process , I did not get the advise to stop the claiming process and I haven't done anything. I was really in a mess the past few days, my husband was in hospital. My IP did not reply to me yet, and I don't know what to do , I just received a letter from my claiming company to pay them 29% of an amount I did not get directly. I also need to know if I claim a critical Illiness insurance , whcih may cover the IVA amount in full not the full debt, will the IP consider that as a windfall? I am not sure that I will get any money from my insurance company as I do not know yet if this is consider as critical illiness, but just need to know the information.
I am lost today, and do not know what to do exacly to resolve the issue with the PPI claiming company and not sure that I SHOULD start the critical insurance claim .
Who is running your IVA? A few companies post on here so you may get more joy using the forum as a go between.
!st off dont worry about the PPI firm as the debt to them may be added to the IVA so if they get pushy just ignore them,you are already in an IVA so your credit rating is shot anyway.
I would suggest a payment break of your IVA to pay this company off.
As for the critical illness payout you would have to discuss this matter with your IP,as it may well be classed as a windfall,I am unsure if it is in any way exempt.
There are solutions out there,but your IP seems to be reluctant to work with you to sort this out!!!

The PPI company's debt can only be added to the IVA if you started the process before the IVA was accepted. If not, then this is a post-IVA claim for which you are liable, notwithstanding that you have received none of the proceeds.
I would write and tell the claims company that they were aware that you were in an IVA when they started working for you, and therefore should have ensured that they secured payment terms with the creditor concerned. If the monies were paid into the IVA as a windfall or asset, then the IP should fund the claims company costs out of the proceeds.
The critical illness payment will technically be a windfall - unless it is paid to you as income replacement in which case it simply replaces your salary leaving you with the ability to fund ongoing contributions. If you are unable to return to work again, it is highly likely that you would be able to broker some form of settlement with creditors, however do ensure that you retain sufficient to ensure a comfortable living moving forward.
