I am 4 days in arrears with my IVA payments having made my November payment on 1.12.12. I have received a letter from Payplan threatening that my creditors will start chasing me for money if I don't catch up. Anybody know how to get blood out of a stone?

You were 4 days late in making your payment and they told you creditors would be chasing you? Seems a little harsh is your account up to date now that you've made the payment on the 1/12/12. Will you be able to make December payment on time?

My temporary contract came to an end at the beginning of September. I started another one at the beginning of October £3500 less than l was previously earning plus a month without pay. I told my IP that i was really strugling and asked for a month off. She said no so l replied and said l would made the October payment at the end of October which l did and the November payment at the end of November which was made on Monday. The letter l received was full of veiled threats and a request to ring her. l would like to know if the IVA can fail if i am only 4 days in arrears and whether my creditors can come after me.....oh and l wonder if Nybody does know how to get blood out of a stone......

your IVA cannot fail surely for a late payment of 4 days...ridiculous is my word for the threats.

Generally although don't quote me on this you have to miss 3 full payments to fail the IVA.
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

That seems very harsh Amanda and seems very uncooperative of Payplan, there is obviously a month where you have had no pay which you will need to make up at some point, but creditors can't chase you unless you fail your IVA, which you have to make 3 months consecutive non payment first for that!

Does your IP know the exact circumstances of the job change and the month in between where you had no pay?

Don't see how creditors can chase you. I thought they couldn't in an IVA and assume that until it's over, you're in it!

I am sure that they wouldn't disperse the money that quickly anyway either. Seems a little OTT to me. Would they allow you a payment break if there's a good reason? We're with cleardebt who sorted ours out over the phone when my car died - and we had a payemnt break on hubby's IVA to cover it as mine woul have taken 3 months worth!!

Advice on this would be appreciated, I am in arrears by part a month, offered to pay back over 3 months but this has been rejected

Have you spoken to your IP or a case worker, maybe contact your IP direct and explain and bypass the case worker and include a copy of the letter and explain what a worry it's caused you.

mab,

cleardent allowed us to repay over 7 months until our next annual review. Reading this forum does make me so pleased we found it and read the reviews before going with some of the other companies around!

Can anyone confirm that you need to miss 3 months payments for your IVA to fail? l am going to communicate with my caseworker by emil only as l want it all in writing. She is well aware that l have had a month with no money but refused to give me a payment break although her letter does end with her promise that she is 'here to help in any way she can'.......lm still waitng.......

I think it will depend on the terms of your IVA - as the name suggests they are individual. Mine says 3 payments.

I think your IP only will be able to give definitive answers as they need to be case specific. I would definitely try and talk direct with him/her

Ahh, so its your caseworker that has denied you the payment break and not the IP? you need to demand to discuss this with your IP Amanda

I have no personal experience of dealing with Payplan, but they do seem to be inordinately difficult when it comes to helping their clients through rough patches !
