Thanks Vicki, just in a rut at the moment! Looks like black horse are not having anything and are cutting off their nose to spite their face. Their money is excluded from the IVA, and I blew my top when IP told me they are being awkward because they advised that it was down to the managements descretion, i feel they have adopted a bit of a "bully boy" approach. I had not had the IVA agreed when my husband took out the hp, which we clearly can afford, and would rather keep the car we already have, than look for another deal, even asked if my brother could be guarantor or take over finance, but they just dont want to know and have spoken to me like i am a piece of dirt. I am a mother of 4, work full time, and am a decent person, who can afford the HP taken out. Management descretion, means that they can make exceptions, unfortunately they don't want to make an exception for a decent person that can clearly afford the monthly repayment. The management descretion call was recorded and I have requested a copy, as I will then speak to a member of my family, who works in legal matters for advice.

Vicki was great and did her very best for us, which we are really grateful for, but Black Horse point blankly refuse to reconsider, and would rather loose money by getting the shortfall added to our IVA.

I have now got to beg my brother to take out finance or a loan, agreed by my IP, in order to get a car, exactly the same to pay exactly the same amount per month for exactly the same period!!!! We really will be up against time as my husband cannot work without a vehicle and this could now result in some loss of earnings!!!

It seems Black Horse are making an example of us, I wonder if they do this to everyone in this position, seeing as it is down to the managers discretion!!!! (Which is what they advised my IP)

It's a strange policy of Blackhorse,they seem to be very anti IVAs as I believe that they routinely reject them.Maybe the car repossesion policy is just a local one and not national ?
Maybe Storm would have the answer to this and the thinking behind it ?

Hi Gill, we were facing a similar situation a couple of weeks ago, with similar options to those your looking at. Every situation is different so I wouldn't want to take a guess at what will work best for you, but I would just say try not to despair. I couldn't see a solution at all and was very worried, especially about getting to work, kids to school etc etc...... but here I am two weeks later with a decent car on the drive again, not new, but low mileage, less than 4 years old, affordable and reliable. The solutionj is out there and you'll find it I'm sure.

Thanks Martin, it has just been so frustrating, when all you have done is follow the IP's instructions.

We are out today, we have had permission to get my brother to take our the agreement for another car for the same monthly expenditure. Thing is my brother can get a better deal, so we could end up with something better than what is going.

I think i was just in despair with Black Horse and the way we where treated (not very nice). Just cause we are in an IVA doesn't make us bad people!!!! If anything, at least we are being responsible. Its not nice to be made to feel so bad!!!

Never mind, they can happily have the car back, loose money on it and we will happily pay another company.

I will let you know when we have it all finally sorted, and thanks for your words of encouragement.

How awful, it does sound like someone is being deliberately awkward with you. I must admit I am worried now because I have a car on HP and have been in an iva since October. I did notice in the small print that if I enter bankruptcy, the agreement would terminate, but it does not state anything about an iva. I have not heard anything form the company so will carry on paying as without a car im snookered. Can I ask which company you were with when you had your initial vehicle repossessed?

Hi Marsha, please don't worry too much, from what i understand , i think this is just Black Horse and the fact that are totally unreasonable with people in IVA's. I would imagine that this clause would be in most HP contracts. If you have have been paying since March 07, I am sure you will be ok. My IP can't believe how un cooperative black horse want to be, and the fact they are happy to loose money, rather than let someone who is more than capable make payments. Unfortunately, my brother who was prepared to take the finance out, to get us another car, and get us out of this mess, is unable to help us now. So i think we have no choice but to lease until we can get things sorted out.

Does anyone know if leasing is allowed on an IVA? and if so, any reccommendations of where i should look?

Ive had my Iva for well over a yr now and a hp agreement with black horse which started over 8 minths before iva , Ive never heard off them regarding my entering into an iva.How can there be one rule for one and another for others , seems unfair that ur being punished because u chose to sort out ur finances. Hope u manage to get this sorted , try not to worry too much xx

It is so unfair with different rules for different people. I am in dispair!!!! They are definately making an example of us!!!

Oh well car gets repossessed tomorrow!!!! not happy, but have found another way round it, with IP permission, so i will be getting a better car, cheaper payments, and 1 year less to pay, and although I know the last year payments will go back into my IVA, so i will be no better off, I would rather that, than Black Horse get it!!!! Sounds bitter, but too right, I am!!!
