IVA approved and made 1st payment yesterday. Just had awful thought ------before i got divorced (with my new partner now getting married soon) i had a joint loan with my husband to AA financial services, in my name and his, this loan was for him, and since we split 2 years ago he has kept up the payments for this. i forgot all about this, could this affect my IVA - help.!!! i hope not ( i wasnt paying anything for the loan so i should be okay shouldnt i) please say yes

Hi, I'm no expert i'm only going on what i was asked! Payplan asked me if i had any joint loans or anything (i didnt so dont know what the case would have been if i had) but i think you should talk to you IP straight away, this might not be a problem if you ex is paying it all, but i was told i couldnt have any credit in my name what so ever! i'd check with an expert to be on the safe side!!

Hi Baz

A slight problem here, in that you should have included the debt within your IVA. I suggest that you get your ex-husband to have the loan transferred just to his name (when AA find out about your IVA they will probably be delighted to do this) and then he can carry on being responsible for the payments.

Did your IP not question whether you had any outstanding joint debts with your ex-husband at the time your proposals were being drafted?

thanks for that melanie. I didnt include it in the IVA because that would have meant i would have been paying his debt, and to be honest it had totally slipped my mind. I cant remembered if i was asked about it or not to be honest. I will ring IP this morning. They wont fail my IVA will they? please say not.

No - this is not a failure point Baz - just needs a bit of administration between your IP and your husband to sort it out.

hi melanie, spoke to my IP at Debtmatters
She said as long as my husband carries on paying it, it is not a problem to my IVA. Only if by chance he stops paying it, the company will come to me for payment, I can then contact my IP and add it to my IVA.
