Hi

I am having an IVA prepared by the CCCS at the moment, I have written to all of my credititors explaining my financial situation, but not telling them about the IVA yet, I have told them that I will be making a pro-rata payment as has been recommended, they have all agreed to this and have pretty much left me alone with the phone calls, the one exception is MBNA, who i owe 6000 pounds on a Virgin CC.

I have explained the situation on the phone, written to them, but dispite this I am sometimes getting bombarded with up to 5 calls a day, wanting me to make a post dated debit card payment etc (which i have no intention of doing)

Is there anything I can do to stop this, apart from not answering the call?

The calls are all part of the waiting game,just be strong and dont give in and make a payments you cannot afford.
Discharged today the 8th feb 2012. View is much brighter now.
Continuing to rebuild our credit worthiness.

Welcome verybroke. You just have to hang in there. The calls are a nuisance, but don't let them bully you!

If your IVA is successful, they will stop.

Out of interest, how much is your total debt approximately, and how much is your monthly payment into your IVA being proposed at?

The call centre staff are probably working on commission so will do anything to try to make you pay. Don't give in to their bullying tactics, just politely tell them that its in the hands of an expert who is trying to sort it out for you.

these call centre people really annoy me sometimes, especially the ones that try an talk over you as you are explaining situation to them, just shows they aint listening so i cut em off

They have selected deafness Michael - if you don't mention the words 'I'll make a payment now', they don't hear you!!!!

Hi Everyone,
Thanks for your comments on the above, most the creditors have been ok, but MBNA are just soemthing else, they dont seem to listen, want me to give post dated debit card payments, like I trust them to just take out what my IVA proposer is saying pay till its sorted!.Oh I have tried everything going from being polite to extremely abusive, putting the phone down, ignorining it etc , but hopefully it wont be too long now, my total debt is 78k..accumulated by training costs for a career change, the IVA proposal is about 445.Per Mth.

The only concern I had was that MBNA tend to vote against if the debt can be cleared in 10 years or less on a DMP. That is not the case so that is good news.

As for the calls, you have done all you can so I would urge you not to worry about them too much. Speak to your provider for reassurance on that point though if you wish.

Not a good idea to give post dated debit card details!

Just continue to either ignore the calls, leave the phone off the hook once you have answered - they will soon get fed up! Get a whistle and blow down the phone (hurts!!!).

You could change your number, which would stop them totally.

Good advice Kallis re post dated debit card details, I have seen far too many cases where a creditor has not only taken more, but then taken payment again the next day/week/month with the same details.

That shouldn't be allowed to happen. They should just take what you have authorised for that date and nothing else.

Agreed, but unless you have a recording of the conversation in question, which you won't have, there are some creditors that are notorious for doing this with the explanation that the client in question said it was ok and you are not in a position to prove otherwise.

Very annoying when it happens.

Hi Very Broke ... welcome to the Forum.

I would say that you are very lucky that it is ONLY MBNA still contacting you, when I was going through my IVA even though I let all my creditors know and payed token paymemnts to them the majority still called on numerous, regular occasions. Perhaps the companies are beginning to wise up to IVAs a little more now.

It is all part of the course Very Broke ... stay strong, and don't give in ... just don't answer the phone [:)]
