Hi guys, I am not sure what to do for the best, i have a creditors meeting arranged for friday 8th of march, i have put forward a f&f offer, my next monthly payment is due on the 1st of march which is £250, my financial circumstances have changed so much that if i make this payment then i will not be able to pay my mortgage, my question is will it affect in away the decision on my f&f offer being excepted if i do not make this payment, i really don't want to ask my family to help with this as they are already supplying the funds for the f&F. btw if the f&f is rejected then i will be going bankrupt

I would pick the phone up to your IP and ask them to allow you a payment break for one month - by which time your F&F will be resolved hopefully and the missed payment could be made up during the time of F&F being accepted and claim closed.

Have you spoken to your IP about this? On your variation paperwork is the amount paid to date inclusive of this months payments?

yes i have spoken to them, was advised not to miss the payment if at all possible as it would put me in arrears, and this would not be good, on the variation paperwork the amount paid to date does not include this coming payment or the payment that i made in february.

Your mortgage payment is important ....I would asked to speak to your IP direct, rather than the case workers and see if there is anything they can do to support you. Your F&F is only a week away and I am sure that your IP would not have submitted this if they felt it would not be approved - speak to them and ask them to reconsider allowing you to miss this months payment ...

if not will your family help you out rather than missing a mortgage payment ? Or will your mortgage company allow you to have a payment break for a month ?

Hi Diane.65. Welcome to the forum. Surely a payment break can be granted - unless you've had the average quota of 3 during your IVA? If so, I agree with lulu that you could offer to make it up during the 6 months to 2 years some firms are taking to close cases!! It's obvious you are struggling, so surely they can provide a practical solution so near to the end. Your priority has to be your mortgage. I really wish you all the best with your f&f. Please let us know how things go. x

Thanks luluj for your reply, the thought of going back to my family again and asking for more money fills me full of dread, my dad is putting forward most of his savings to help me and i really dont want to push my luck as everyone involved in my situation are at their whits end and desperate for the F&F to be accepted, i really wanted to know that if i didnt make the next iva payment could this go against the F&F, if it would then i would have to bite the bullet and speak to my dad again,

only your IP is going to give you a definitive answer on this - we can only give our opinion ...I would hope they would be favourable to your siggestion x

Sorry GilliB, i missed your post, i have only been in my iva for 7 months thought we had turned the corner when it was approved then disaster struck (long story) so had to tell my family about the iva, and they have offered to help, maybe shouldnt have kept them in the dark in the first place as they would have helped me along time ago but "pride and all that" any way i will try to speak to my ip asap and try to get something sorted out.

If you miss this months payment it shouldn't 'go against' the F&F settlement. If, on the variation paperwork it shows paid to date plus the F&F offer (less IP fees) and then the p/£, then in reality this months payment has not been included. If they'd taken it into consideration when drafting your variation, then it should show on the paperwork. You need to speak to your IP, however if your creditors agree to the F&F then they are not expecting this months payment.

I offered my f&f 2 months ago and was told not to continue making my monthly payment as this would help the case of my f&f being accepted which is has now been

Hi Matt.01 that is good to no that you did not make any more payments once you put your F&F forward, can i ask which company you where with? I am with Freeman Jones and so far they have been great, i will speak to them again tomorrow and explain that I am unable to make any more payment into my iva and then i will have to wait and see what the outcome of my creditors meeting is, if its not excepted i will have no choice but to go bankrupt.

well have spoken to FJ twice today, first time it was a guy from the payment team, was told that if i just make my payment then if the creditors meeting goes my way i will have the payment refunded, that's still no good to me, as i still don't have the money to pay, i also need to send in proof as to why i cant pay, when asked what would i need to provide his reply was, just whatever you think we would need, what does that mean?? so came off the phone none the wiser, so rang back and spoke to a lovely girl and explained everything to her, she advised me to hold fire and wait on the outcome of the creditors meeting and deal with whatever happens then, so that is what am going to do, btw when i asked her if the payment was made and i had a good outcome at the creditors meeting would this payment be refunded, her reply NO
