MelanieGiles: The creditor concerned is Welcome finance. Going back to 04 I got a loan from them in which stupidly (very) I topped up periodically until I had to go secured due to value of loan. The last "top up" paid off my exsisting loan, gave me the extra cash I needed but was never secured on my home. At repo at court the duty solicitor explained there was only one charge on the property ie RBS. The sale covered that no problem but welcome never actually even registerred the loan with land registry. On paper so to speak my previous one was paid off and I didnt get another? I filled in DI for WF and they accepted, but took me to court for over £50k+ and ccj with attachment of earnings order.I will be 93 years old by the time paid off. Their solicitors have indignantly told me unless I make substantial repayments to clear this debt they will simply take me back to court every 6 years and so on, infact I quote I was told I'll never be able to get credit again certainly not a mortgage as they will apply for a charge on it?
Kallis3: Yes foolishly I did give them debit card details of the bank I use...unfortunately only yesterday the card was lost and had to request a replacement [;)]

I'm glad you got the card sorted! At least they cannot take any money from your account.
Barclays and Nationwide are fine, as are the Co-op. I take it non of these are creditors?
The sooner you can get the ball rolling now, the sooner you can get the hassle stopped and get on with your life without this hanging over your head.

Having read through various sections on this forum I'm a little confused as to what happens exactly with the iva? Can you give me a short run down ie application/creditor meeting start of iva and reviews meetings moving forward etc please [:D]
You should be ok with getting an account, particularly as you are pre iva.
With an IVA you firstly speak to a company, obviously the choice is yours as to who to go with. They will note down all of your debts and tell you whether an IVA is feasible. They will go through all debt solutions options with you.
If an IVA is the way to go then you submit details of all of your creditors and the amounts owed.
The IP will then draft a proposal which will come out to you and you check it thoroughly and then sign it and return it. A couple of weeks after that will be your creditors meeting.
If the IVA is approved then your creditors can no longer hassle you and you will commence making your payments.
It varies from company to company as to when they require payslips - Payplan want them every three months. You'll have a review every year to see if your income and expenditure have changed.
If you earn extra or get a payrise then you may be required to pay some of this across.
At the end of the term, provided you have kept up your payments, your remaining debts are written off.

Okay I understand now. Can I be completely honest [:I]for sometime now I've been walking around with my head in the sand and I quite openly (although ashamed to admit)been filing all my debt letters in the bin, I suppose hoping they'll go away?
I actually have very little knowledge now of exactly what is owed to who, what for and when. Exception been Welcome that is and recent debts that have arisen?

As I am unable to get credit etc, earlier in the year my car broke down, well actually it threw the teddy right out of the cot, down the stairs and out the door...it's was finally goosed. My dad (very kindly) financed me a newer car, diesel to make things easier for me and what I save in insurance/tax and general running costs of my old car simply pays for the finance on my newer diesel. A car is a must as I work shifts and travel approx 250 miles aweek starting at 6am?
Since the finance isn't actually mine but I pay my dad weekly, what then?
We've all been there! I kept everything from my husband until one night a creditor called and it all came out and made him quite ill. Not good either that it was on my birthday!!

Are you getting statements from any credit or store cards you have? You can always request a copy of your credit record from one of the agencies although I warn you it probably won't make for good reading!! That should list who your creditors are.
As to the car, some people are allowed to pay for a vehicle alongside the IVA payments and once the finance is finished then that money goes into the pot.
It's something to discuss with an IP company.

I can top that my home was repo'd on my birthday! Anyway thanks again for the reply, I've been making notes on questions to ask and contacted Melanie Giles direct as I think this is somewhat unusual in the issues I have with welcome etc. The car is financed by my father and all paperwork is in his name except the V5 (insurance/tax etc), strange really my dad is almost 80 and can finance a car yet I can't (I know why but seems strange?) I plan to contact such as equifax/experian and get this soughted once and for all,try and make a clean sweep of it all. I dont have any credit cards so dont recieve any statements etc, but some solicitors letters wanting my blood.
I'll keep you all upto speed as it may just in someway help someone else as you've all helped and supported me....just a long way to go but as they say every journey starts with the first step [:D]
Melanie comes highly recommended on here and she is a lovely lady, I've met her several times.

i had a problem buying some boots off the net,they were fakes(expected a brand),kall advised me, i rang my bank- new card,phew,it gave me a fright!
my hubby had his head firmly in the sand,our debts came to light when someone rang me to say a card payment had failed,it was a terrible shock. he's much better now,he must have been terrified.
