Thanks for all the info Lily , it re- enforced what I already believed..
And a lot of it is in the Defence statement/claim I have submitted just in case.

I know the IVA is going sort out the court case but its just such a pain.

But our biggest worry is if any collector types come visiting the door..
One would be just about Ok but if two arrive it could cause us a real problem .
You see my daughter has been trying to get Murphy on a diet and he is fiercly protective of her and my little grandson with strangers about.
He could manage to get down one but 2 would probably give him indigestion. and I would'nt want to have to clear it all up ;-)

BTW Murphy is their large golden labrador..

Todays Update..

As of midday today the claim is still active, our counter claim is in and I have confirmed its receipt with the NCC.
Got the IP to ring the tozers ( B carter & co) again while I was on hold ..
and the tozers .. said they had not rec'd any paper work (chairmans report etc).. when reminded that they had already admitted receipt of the paperwork last week, it all changed to well we have all ready contacted the court etc etc ..
Wot a load of porky pies ..
Well I just hope now it actually make it to court as the NCC have told me after they rec'd a copy of the IVA chairmans report that the claim will be thrown out anyway .
So will leave this one simmering and will pass the time with sorting out the other problem creditor harrasments, chasing card charge repayments.

The IP has now done the annual revue, and the monthlys payment has dropped by a bit .
But in March 2009 the available disposable income will drop to £52,so I think as this is inevitable the Big BR should get started, will need the chase the IP on this .

Still waiting to see what BC and CO's next move are, I've had written confirmation from the Court of my defence statements and BC have still not done anything ,its all still active , the court say they ( BC) may just leave to continue and it will get thrown out but if they do this they stand the chance of my claim being made against them, for exemplary costs for a frivolous or vexatious action, think thats the right legal terms. but we will see.

And Today .. another creditor, this time the HSBC, again who agreed to and are contained within original iva , has started and sent a debt recovery letter via one of their own scavengerpacks.. oop's I mean "Central debt recovery unit" in Worthing.
Have just compiled a really nicely ( I think) worded P?ss off
letter to them . so we will see where this goes..

I do hope you win your claim and get some compensation out of them.

Not as yet !.

BC have got 28 days to reply to the court after receipt of the defence or the claim will be "stayed" then after that time they can only apply to the judge to have the stay removed and have a good reason to do this !

This morning we received a letter from the tozers, saying
notice of Discontinuance of proceedings, so they finally got the message

Looks like now if we want any costs for harrassment we will have to do a seperate claim..
So probably won't happen !

Off now to run throught the credit card records we've got today so see what charges to claim back ... Esp as its MINT today.. the court claim client !!!

Glad they have finally seen sense. They obviously didn't want to pay any compensation.

This is just the mint CC, still awaiting reply from HSBC ref my last letter to them and their debt recovery gang.

I.E A P?ss off she's in a IVA letter.

we will see if how far they want to go ?

Just confirmed MINT CC made 169 pounds of charges on this Card account. inc 2 PPI charges the first one 8 months after the IVA started and one only 5 months ago.. and PPI was never requested initially..
what a load of crooks..

Hi to all ,

Its been quiet since the court case got dropped.
Had another solicitors letter from another creditor, seems like they all all taking turns at it ?.
But no problem any more..to deal with.


But now back with a question.

The IVA has recently been adjusted for a changes in Income..
and as mentioned before.. will fail next april due to income.


My daughter has a new boyfriend ( one we all get on with !!!)
So .

Q.. If he was to move in ?? what happens to all the IVA/ finances.

She will lose the 25% single parent council tax allowance and the tax credits will go down.

So this how will this affect the IVA if its still going on .
or any bankruptcy when we go that route.

Would the new partner be expected to do with regard to the IVA ??
nothing i would hope !!

Any other aspects I'm not aware of , any help here please ..
