Hello, Problems with shop direct!! Getting worried that IVA won't be accepted.

Hello, anyone else had problems with shop direct!! It doesn't matter how many times I tell them I am going through the process of applying for an IVA, they still keep ringing. The lady last night was quite aggressive asking why I was in unable to pay my debts and that needed then the £100 that was due it didn't matter I was going through an IVA I still had to keep up with payments. If I could do that then I wouldn't be going through an IVA!!! I ended up hanging up on her. All the other creditors have been ok, understanding in fact. I just hope Shop Direct don't cause a problem when the proposal is put in front of them. I so want this over now so I can start counting down. How long do creditors let you miss payments before they start action. I currently waiting for my proposal to be amended so I can sign and send back so hoping that a creditors meeting will be held by end May / beginning of June. By then I would have missed three months of payments. It has been good as we have been able to put some money aside for emergencies in the future. But getting worried that my IVA won't be accepted and then our hole we are in will be MASSIVE!!!! Sorry for the long post but this forum is my lifeline, it gives me strength. Thanks everyone for listening.

Hi

How much do you owe Shop Direct and how much are your overall debts?

It really is not unusual for some creditors to still chase for a payment right up to the IVA meeting, however don't think that this will mean that they will reject because it doesn't

i had this with shop direct until they received the proposal and iva was accepted you could just not answer the phone or give them ypur ip details and tell them to deal with it that way

Hello, my overall debt is £45k with £16k being Shop Direct. Years of buying Christmas presents and kids clothes via catalogues not mentioning their massive interest rates...

So 4kids you got approved with them, what proportion of your debt was with them?
These attack dogs chasing payments are usually ignorant even about the basics of an IVA. Easy to say I know but don`t even answer if they`re being that nasty and unreasonable.

we had approx 3k with them on a 39k debt but they agreed no claim hyperdrive

I just made my first payment of a 60 month IVA last week and have similar debt to yourself. I know the calls are annoying but it has all stopped for me now and its so nice being able to budget each month and know exactly where I am. I would insist on just giving them your IP's details and case number and tell them to talk to them direct. All the best:-)

just out of interest and hopefully I don't even have to think of this. But what happens if iva not approved. Can you ee-apply or is it straight yi BR.

You could temporarily go onto a DMP and apply for an IVA later on, it's not straight to bankruptcy.

The meeting can be adjourned to enable your IP to canvas some more votes in your favour
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

I have been in an IVA for almost 2 months now but Shop Direct (I had accounts with Isme and Very) still keep sending me monthly statements saying I owe them X amount and I am X payments behind, and they are still adding non-payment fees and interest onto my account, and also PPI is still being charged to my account. No different to the usual statements I used to receive - it's as if they are not aware I'm in an IVA! They voted in favour of my IVA so I'm not sure why they are doing this but I'm not too worried because they aren't going to get any extra money from me! As I understand, the amount agreed at the creditors meeting still stands so they are only complicating things for themselves by adding more money on top. I haven't had any calls from them since though which is good.
I never answered the phone to a number I didn't recognise in the run up to my creditors meeting, and I'd missed about three payments on some accounts by then too, but if you prefer to answer then every time they call just give them the details of your IVA company and reference number if you have one and tell them they will be in touch with a date for the meeting soon. This probably won't stop the calls but at least it'll keep them short and sweet. Some companies will try everything to get a payment from you, including shock tactics and borderline harrassment, but once your IVA is approved... the silence will be golden :)

have you sent all S/D letters on tp your ip.
I had one company sill asking for payment after going into my iva. sent letters on to ip that soon stopped them
IVA now over with and it was worth it.

That is quite concerning (mummytoelliekate) i would be interested to see what one of the experts says about shop direct still writing to you every month and still adding charges whilst in an IVA.

Slekclarke, if they won't listen to you then unplug the phone and let them ring away! As soon as your iva is settled the peace will be lovely. Your IP wouldn't be putting your proposal forward if they didn't think it had a good chance of being accepted, even with amendments. Good luck to you.

Sleklarke it`s not 75% of the creditors, but 75% of the creditors who actually vote, as far as I understand.
Press your company to earn their corn, even supposing a worse case scenario, there will be leverage when push comes to shove.
