It's post IVA Melanie ... the time from when my daughter vacated the premises (I can't believe this has been going on a for almost a year now!) until the 31st March this year as, of course, I am still liable for the lease. Hopefully we will be reaching a conclusion soon [:(]

MELANIE,
IF THE COUNCIL WHERE NOT AGREEABLE WHAT WOULD I DO CONTACT THE COURTS AND EXPLAIN THE CIRCUMSTANCES OF SERVICE. ALSO INFORMING OF THE WRONG AMOUNT ON THE DEMAND. WHAT WOULD HAPPEN THEN TO THE DEMAND?

I would go to your local CAB and explain the situation to them. CAB's maintain good relationships with local authorities and I am sure will have this sorted out for you in a jiffy.

Melanie beat me to suggesting CAB they will help you sort this out and will also know about asking for a backdate of Council Tax Benefit. When the house first became empty he is entitled to 6 months at no Council tax payable providing all the furniture has been removed as you say and then I believe his Council Tax reduces to 50% but CAB will be able to help you with all of this - You will have to provide proof etc. Best of Luck and all good wishes to your dad too. THANKS MELANIE,RAINBOW, SOULGROWTH,CHRIS.G.FOR YOU COMMENTS. I HAVE JUST LOOKED AT THE DEMAND AND NOTE THE DATE IS NOT THE 7TH OF JANUARY BUT THE 7TH OF FEBRUARY SHALL I SET JUDGMENT A SIDE BEFORE THE 18 DAYS ARE UP?

I HAVE BEEN IN TOUCH WITH THE CAB SOME WILL RING ME BACK TOMORROW WITH SOME ADVICE. I SPOKE TO THE COUNCIL TODAY APPARENTLY THE 50% FOR THE PROPERTY BEING EMPTY HAS NOW BEEN STOPPED. IF THE PROPERTY IS EMPTY YOU WILL STILL HAVE TO PAY THE FULL 100% COUNCIL TAX SURLY THIS CANT BE RIGHT.

I think my council tax bill for the empty shop premises is 25% of the yearly total.

Glad to see that you are getting some help Frank. How is Dad today?

TO ALL,
I HAVE JUST FOUND OUT IF DAD IS AWAY FROM THE PROPERTY GETTING CARED FOR, BECAUSE HE IS SO ILL THERE SEENS TO BE NO COUNCIL TAX PAYABLE. I HAVE TO CHECK THIS ONE OUT. HAS ANY BODY HERED OF THIS BEFORE ?

Seems reasonable to me - are the CAB going to put this forward to the Council on behalf of your Dad?
