Back in August I was promised that a PPI disclaimer would be sent to me.
email from GT:
"As confirmed on 3 August 2012, EIC have been instructed that you do not believe you were unfairly charged and no claim exists. A Declaration of No Claim will be sent in due course.
I apologise the delay in responding resulted in EIC initiating proceedings but this should cease. I would ask you disregard the correspondence you have received from Clydesdale in this regard.
Should you have any further issues as a result of this matter please let me know however I don't anticipate there being any."
To date this disclaimer form has still not arrived.
Today around 6pm I received a phone call from GT on my mobile regarding passing my details on to EIC (i.e. starting at the beginning of the August discussion all over again) and no matter how many times I said that I am 100% sure that I was never missold PPI and that I was promised a disclaimer would be sent to me back in August the guy on the other end insisted that he "understood my position" but he really needed to send me a consent form for me to allow GT to pass my details onto EIC so that the investigations could begin and that it was necessary to keep things in line with the IVA agreements.
What is going on? Has anyone actually received a disclaimer in the post yet or is it just a fallacy?

It may be the case that due to the size of GT's IVA portfolio that your case has slipped through the net. My understanding is that advice currently in preparation for IPs from our regulatory bodies will confirm that investigations into mis-sold PPI must be carried out on all creditor claims, regardless of whether our clients feel that they were mis-sold any unwanted products, but that this should not delay cases being closed or Certificates of Completion being issued. So this may now represent a change of direction for your IP which is regrettable but necessary.
Exactly the same with me. I'm 100% positive that I did not have PPI, was told I'd receive the Declaration of No Claim, got another phone call four months later and now received all the claim paperwork today! That paperwork now resembles a 10,000 piece jigsaw. As I creep into month nineteen since my final payment I have lost all sense of reasoning with them. I only had two payments left when GT took my IVA over and they have ruined my life more than the IVA itself did!
Well, it's been another 4 weeks almost and I've received no forms or letter regarding the above yet. The guy on the phone said if we get on with it it'll be all done and dusted in 6-8 weeks...FAT CHANCE!!!
Does anyone know if GT (or any IP for that matter) receive any sort of finders fee from EIC (or other third parties) for details of those in an IVA and possible PPI / bank charges claims.
I would have thought personal information held by the IP would be covered under the data protection act, but as I know next to nothing about the act a reply off someone who does know would be interesting.
Also does the data protection act apply for companies located in different countries, someone once said they though EIC were located in Southern Ireland..
EIC are mainland UK based. I doubt the IP gets a finders fee, but, of course, they will benefit from 15% (dependent upon the fee structure in the proposal)of the realisation.
I would imagine that, somewhere in the maelstrom of paperwork, we have signed to give permission for our details to be shared with "partners".
My opinions are merely that .. opinions based on experience. Always seek professional advice.

Hi Foggy,
After I did the first post I did a check on EIC and they are the trading name for a company registered in Southern Ireland. They might have a UK office but they are not a UK company.
I received a disclaimer within 4 weeks of signing the letter for them to make a claim. I'm with Freeman Jones and they have so far been relly good and efficient. Now waiting for my completion.
Wish mine would turn up. The 6th anniversary of my IVA is in september. I'm due to clear my payment arrears by april. That's a window of 6 months for the PPI nonsense to be processed and a completion certificate to be posted to me. By most accounts on here, that may not be long enough (I'm with GT).
Seems like it komokino. You'll just have to grit your teeth for a bit longer. Seems some companies still can't see they are playing with peoples live. I await my usual contradiction from another poster.

Completed IVA - August 2012 pheeeeeeeeeew
Only my opinion - Nothing More Nothing Less
You're okay Foggy. (I was't inferring you incidentally). Reading the posts today, including this one, really does make me quite cross, when all this business needs is concise regulation. The IVAs, for clients, are very stressful from the onset. But to compound that stress with maladministration, timing blunders and a dozen other reasons simply isn't on.
During my IVA it was just so much simpler. Had I have had it now, I really don't know how I would have coped.

I think we are completely on the same page TA. I am oft spouting about such things!
Too much is left to discretion, which, as I have said elsewhere, was, I believe, initially to allow IP's to assist debtors in the process. However ( with my usual caveat of "with a couple of noteable exceptions) many IP's have hardened their attitudes over the last year or so (galvanised, in my opinion, by squeezed fees and the devious device, introduced by creditors, of being paid a percentage of realisations --- paid by results --- commission, if you will).
We debtors are no longer the client.
My opinions are merely that .. opinions based on experience. Always seek professional advice.
