I am in an IVA almost 4 years ago.
They are wanting to review my case and cancel the agreement due to a break down in communication.

Hi and welcome.

Have you been making all of your payments on time?

Which company are you with? I think you urgently need to speak to your IP about this as there must be some reason why they are wanting to fail you.

If you've made all the payments and have got this far why are they saying breakdown in communication. Sounds a bit weird to me.

Hi - the reason for for failure wouldn't be a breakdown in communication; it would be because they believe you have breached the agreement in some way. What's happened? X

I have not missed any payment as I paid montly by standing order from my account.when i phoned to ask why they have not contacted me as arranged, they started given excusses like ,'you failed to meet up with your payments in which i contected. After checking their record, it was found that i did not miss any. Then the lady said we arranged an appointment on the phone with you but you failed to meet the appointment as you did not receive the call.This again i disputed it as no call was made to me. Then she said we asked you to forward us with your expenditure but you failed. I then forward the proof of fax and again the expenditure form to them. After she receiving the expenditure form, she then call me continue because of the arrears in my account. I could not believe this it was then i realised that they are looking for flimsy excuses. I would ask to speak to your IP directly and not an administrator. Looks like there HAS been a breakdown in communication .... within Grant Thornton's own offices. I am sure the IP would not be amused at the flimsy excuses being thrown around.

Yes, you might be right as the same letter heading of Grant Thornton with same address but different fax and phone numbers. I realised this on Monday when I faxed my expenditure forms to them and I was told that it was not recieved. but the fax printed out that it was successfully sent. when i contacted them to confirm their fax number, it was then i knew that they are using two different fax and phone numbers on the same company's name. i then realise that all the while, i have been sending it to the other number. when i asked them to go and collect the documents i faxed to the other number, she relpied sorry we can not go there. I was suprised her reply. After this i started suspecting somthing fishy. Please kindly advise me what step to take and what do you mean by IP? Thanks.

Try IVACustomerServices@gtuk.com . I've always found them to reply promptly and sort things out.

IP is the actual Insolvency Practitioner named in your IVA proposal. At the end of the day it is this person who is responsible and is putting his or her name to your IVA. Either ring up GT and ask to speak to this person directly or you can get her direct email address and email her directly.

Don't let them pass you off with "He/She is not available" etc.

You're paying them to manage your IVA and they should make time to speak to you if you need to. I've always found GT very helpful so fingers crossed for you.

You are entitled to speak to your IP so insist on it. Sounds like the office people aren't sure what is going on either.

i have just spoken to the IP representative who said that there is nothing she could do unless i sign another contract with them and that they have to speak to the creditors if they can still allow me to pay the same amount which means that i have to start allover again. all because I missed the telephone appointment.

But what was the telephone appointment about?

They can't just say "You missed the call, tough etc"

You said IP rep. Do you mean the actual IP who is named on your chairmans report or another person on their behalf?

If it's the latter demand the actual person named on you Chairmans Report.

You also need to demand a full explanation from them. What this telephone call was about, why it was required, why it is that it's all too late etc. Get it in writing after they have explained it too.

It all sounds very strange....

You must insist on speaking to your IP. If I had been paying for 4 years and was then told it was to be cancelled I'd be on their doorstep right now with every piece of evidence that I'd complied and I wouldn't leave until I saw my IP.

Please don't be fobbed off any longer!
