Good Afternoon.

I was in an IVA and made my final payment in November 2012. I was told at that time that it generally takes 6 months to get my case closed, but now due to PPI and changes in VAT I have been told that this is no longer the case. I have signed and returned a Declaration of No Claim back to Grant Thornton months ago which took care of the PPI, but this still hasn't made a difference to getting my closure certificate and they are now saying I need to sign an MVM Proposal.

My main concern is that I have done exactly what they have asked of me throughout the whole process and they seem to keep moving the goal posts and what is to say they wont do it again if I sign the MVM? At one point someone actually arrived on my doorstep and refused to leave until I signed their new T&C's.

Please can you advise where I can go from here as I feel completely at the mercy of Grant Thornton.

Many Thanks

Hi James.01,

They actually sent someone to your house to harangue you !!!...Incredible.

Hopefully an expert can offer you some advice shortly.

HI James are you saying they made you sign? you have signed? they have no right to do this in my opinion it states on the bottom of our MVM letter if we decline or do not answer the IVA will remain on its original terms ,check the letter and complain

Hi Goosend. They did indeed! In hindsight I wish I'd just called the police, but that's the beauty of hindsight I guess [:D]

4kidsnocash: Apologies, I'm not sure if I explained myself very well. I have yet to receive the MVM Proposal (although they say they've been sending it since Feb) so I'm not familiar with the wording. When they sent someone out, this was a few years back and it was again to make a change to thier T&C's. At first they kept calling saying I had to sign them, but I kept saying that I'd perfer to stay on the original Terms so they sent this guy out who refused to leave until I signed.

Hi, well I've heard it all now! hindsight I agree is a wonderful thing.
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

I feel for you James we are in a similar position now if you read my Grant Thornton thead, do not sign the MVM if it is not right for you, only you will know if it is and do talk it over with one of the experts on here, as I say I can only go on my own experience but sending some one round and making you sign beggers belief

Thank you 4kidsnocash. I'll definitely take a look at your Grant Thornton thread and I hope you get yours sorted too. I'm wondering whether it's worth putting in a formal complaint to the financial ombudsman regards the treatment I've recieved? It's always difficult as you don't want to upset GT too much as I just want them to give me my certificate [:(]

I frankly am at a loss as to what to make of this, as I do not see any need for a concluded case to be varied, unless I am missing something?

Good morning MelanieGiles.

Thank you for you response. Do you think this is just further delay tactics from Grant Thornton?

Yesterday I sent them an email saying that I've had enough and if I do not receive my closure certificate within 28 days then I have no choice but to contact the financial ombudsman.

I'll wait to see where this gets me, but I'm not holding out much hope. I'd be lucky to get a response to my email within 28 days, let alone my certificate [;)]

Again, thank you all for you advice and wish you all the best in completing your IVA's. Will post back once I've got a response from GT.

James

Don't you go into a IVA to stop anyone calling at your door about debts.
Now we have a IVA company doing just that and saying you have to sign or we wont close your IVA.
I would be sending a letter to my MP.
IVA now over with and it was worth it.
now starting my life again,

I am no legal expert but if you have signed a declaration of no claim then how can you then make a claim!!

As people have alluded to before Mel the only benefit to the IP to vary a concluded case is so that they can try and make a miss selling claim, PPI, bank charges etc, then they can make a consultancy fee from the PPI reclaim company and a 15% IP fee....

As we have seen on the internet the number of IVA cases is dropping so IP revenues are falling and they need to find other areas of revenue to support their business..
