Hi 5 years ago i emigrated leaving my debts in the uk(approx £30000, 6 creditors). This was not done on purpose family probs.I have had no contact with the creditors since. I am now back in the u.k and living in a different area. Would the creditors still be looking for me after this long or do they give up after a set time. Thank you

Hi Fatroose and welcome to the forum - I am no expert but as far as I understand for non secured debt the creditors only have 6 years from the date you last admitted you owed them money to track you down and get their money back. I am sure an expert will be along shortly who will be able to tell you for sure.

Yes, Rainbow is correct that there is a six year period under the Statute of Limitations Act.

Hi Melanie
Thanks for your advice. Could you tell me the best way to open a bank account or by doing this would i attract attention from my creditors?
Thanks again Justin

Hi Justin

I'm not really an expert on the bank account front to be honest - other experts will be able to help you with that? Is it your intention to address those "left-behind" liabilities, now that you are back in the UK?

When applying for a bank account you will need to give 3 years residential address - however in that you have lived outside of the UK for a period of time you will probably be able to open the account without creating an association to your past.

It should be noted the trace processes used by the major CRA's is very comprehensive (and getting better).

Once you apply for a bank account you start to leave tracks or 'crumbs' - this is the phrase used by the trace systems that are constantly looking for missing debtors.

If you owed anything to the HMRC they will know you are back once you get a job.
