Even though my IVA is completed and I have a completion certificate, I was contacted by EIC last week and quite forcefully requested to provide an electronic signature to authorise them to request details of my financial details from GT.

I did as requested but as GT no longer act on my behalf are they obliged to provide this information?

Even if they do and EIC successfully manage to claim some money, how can GT pay it into my arrangement, it doesn't exist any more, I am officially debt free all my creditors have been paid as agreed by the terms of my IVA.

In this case what happens to the money [?][?][?][?]

Hi

I can't see how you are obliged to do this now that your IVA is completed and your completion certificate in hand.

If they can claim refunds post IVA and distribute to creditors via the IP why is there to any need to hold up current IVA closures ?

Now that my IVA is complete I no longer have any creditors, they have been paid in full and I have been legally released from any further obligations.

GT are no longer acting on my behalf and there doesn't appear to be any mechanism available to pay creditors any further funds, so what happens to any money claimed back?

It would seem IVA's can be completed without having to claim PPI first, I'm living proof of that, what I'm struggling with is how any money claimed can find it's way back to creditors post IVA.

No idea northumbrian69, i think this is untested waters to be honest, perhaps one of the experts on here can help you with your query, hopefully you will get an answer soon. x
Om shanti, namesté, good luck to all who are embarking on the IVA journey, it isn't always an easy one but the outcome is the best.

IVA COMPLETED August 2012, received Completion certificate 18.4.13.

Did you give GT authority to pass your information on to EIC? If I were you I would write to EIC requesting they don't use your signature.

No disrespect to you Karol, but, the customer services team at GT are not the best. We had the infamous EIC letter from GT and contacted customer services and whilst I was assured my details would not be passed on my wife was rudely spoken to when she said exactly the same as me. They told her that until they received a completed disclaimer her details could still be forwarded (we have still not received a disclaimer and its been quite a few weeks now)..

We have subsequently been contacted by EIC who say they have our details, told them they should not have them and they came out with the usual they have to do it or we are in breach etc etc and were quite indignant when I detailed that the only reason we did not want our details passing on was because we were in the middle of making our own re claims as we did not see how they could justify their fee and wanted all the money to go into the IVA pot, as one would expect this did not go down well......

I have also been told twice now that they'd put a disclaimer in the post but not received anything.

Maybe Karol could chase these up with you. This ppi is a hot topic at the minute and I'm sure my time is yet to come with a claim!
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Hi Lesley, I'm hoping now that we have got the message over to EIC loud and clear it will be the end of the matter. We have had "other" dealings with GT customer support and they do act as a sort of brick wall where all calls end.

The last contact I had with them was re a possible reduction due to a mortgage increase (figures were within the 15% figure) I was told I am not entitled to a reduction but could get a sort of deferment whereby any reduction that was applied would be added on to the end of the term (I have missed no payments, have added extra into the pot and even after allowing for the reduction will pay back over 90% which is above the original target figure)..

I asked if I could speak with the IP handling my case and was told that I do not have a specific "case advisor" and that all issues / calls / questions etc etc were handled by customer support....

They have now asked me to do an I&E review submitting proof the mortgage has increased, copies of my monthly expenditure and details of monthly income so they can "better understand" my position..

All this has only arisen as they "forgot" to factor into my IVA that the mortgage was scheduled to increase in Sept 2012...........

Too late I have already given my signature.

I'm not bothered if they want to try and recoup any money, what I don't understand is what happens to it if they do, I am no longer in an IVA and my understanding is, legally I no longer have any creditors, they have all accepted the terms of the IVA and been paid accordingly.

Just got reply from GT Customer Services:

Should you obtain any funds from this source, you are able to retain to full amount for yourself. The funds are not subject to the arrangement as you have fully complied with the terms and conditions of the arrangement and any account within the IVA will be marked as satisfied and closed.

I don't know if EIC will get anything back but if they do, it's all mine [:D][:D][:D][:D][:D]

You will have to check that your electronic signature only gave authorisation for them to obtain your financial details and did not give them authority to chase PPI etc.. or you may be liable for their fees off any money they recoup....
