I am cancelling my IVA, I informed Payplan of this last week, I asked them for a rough timescale of when I get my failure certificate. The reply I got is that they have to ensure that all the Information is correct on the Failure Notice before they can send it to me and my Creditors. They also have to make The Insolvency Practitioner aware of my request to fail. He needs to sign off on this before the failure process can begin. As they are unlikely to give me a timeframe (whether through no fault of their own) I was just wondering if any of you guys know how long it should take?

It is impossible to say but you do not necessarily need it to petition for bankruptcy. Advise the judge that the IVA has failed and that you do not have the certificate. He/she can grant the order and that sorts that.

Thanks for that. Just need to raise the money to do it now. I have a meeting with a debt charity about my income and expenditure it looks like I will be paying more or less the same into my IPA than my IVA. But, of course with the IPA it is a far easier process to change. As it will when my wife goes on Maternity.
