I am sure your IP will sort things. Your daughter's dla is hers at the end of the day, and the creditors will have to understand that. You are doing your utmost best to pay them what you can and there is nothing more you can do - whilst continually caring for your daughter. The whole DLA thing stinks. I had to go all the way to tribunal last year as the DLA people tried to take away my son's dla saying he wasn't disabled enough! He has 15 diagnosed disabilities from the hospital, psychologist, and the Psychiatrist for the High Court. I was in for 5 minutes and the judge asked why I was even there and the group of judges ruled immediately to have it re-instated. A waste of stress, money, and time! (it took 9 months to go through!) But we have to do what we have to do for our babes - we have to be their voice. You are doing fab Merry and should be very proud.

You both should be very proud and it is obvious that you have both put the care of your children first and foremost and you should both be congratulated. What saddens me is that you both have to keep fighting for dla money when it is obvious that it is needed without continuous assessments which must cause so much stress. Why do we have to have so much red tape when it is plain to see that the situation is geniune. I wish you both the best of luck and offer my congtaulations for what you have achieved.

Hi all back with an update! just had confirmation after 15 years my daugthers will recieve DLA indefinenetly - about time too, no more regular reviews, now got to compose a letter to IP as the money in august goes to her. any ideas anyone how and what to put in it as it means a drop of iincome for of around £280 per month ( we pay £794 per month to IVA at present) thnx in advance
Just explain that once shes 16 its legally hers and she needs it to cope with her disabilities. She will be gaining more independance and that money would help her a lot with that. She's entitled to grow up just the same as any other teenager.
Im sure your IP chould arrange a variation and your creditors should be sympathetic.
I wanted to keep my kids DLA for their needs myself and I told the person that was going to draw up my IVA this in another life ( lots of water and sewage gone under the bridge since then).
My son had a GNT, Aspergers, OCD. He also got the money indefinately for life at 15 He has always tried hard and shone through, when he was 17, we found a driving school with a special needs tutor, he passed his test and has never looked back. He really lives his life now, its given him confidence and freedom. Your daughter should have that money for her own needs, so I would kind of tell the IP (nicely) rather than ask, its not a request its a must. Some do understand some dont but how would anyone know if they have never lived with a disablitiy or watched a loved one struggle with one?
There should be no issue having the payments reduced unless the original IVA had allowed for the DLA to be excluded and used solely for your daughter's needs.
The whole I&E will need reviewed but creditors are generally sympathetic and should agree to a reduction in payments.

Merry, Poppy, Mes Skint, Lili - you are dead right - those of us never to have experienced what you go through can fully appreciate your sacrifices. What we can do though is marvel and admire what wonderful people you all are.
Merry - I would happily compose your letter for you - it would be grammatically perfect and error-free but have none of the passion and committment that would come from doing it yourself as shown on these posts. YOur IP would need a heart of stone not to be moved!!
thnx all, I ahve now written a longgggg letter adressed personally to my IP and will post it tomorrow fingers crossed lower payments will be recommended and accepted by crediotrs . we will still be paying over 50p in the pound so a good return . thanx for your support . posting it tomorrow

sent a detailed letter addressed to IP last week . recieved a phone call today from a member of the customer care team, we completed a new IN?EX sheet whilst on phone she is going to suggest to my IP we go for a reduction and should therefore have another creditors meeting. she is going to let me know what the outcome is when she has spoke to IP. lowering payments by £250 per month(still paying £514)so couldnt foresee it being a problem as its still a big return but said they may request an extension of 12 month to get more back . will update as soon as . thnx all
