Blackk horse - responded straight away, corrected the dates and proved they issued me with a default notice.

Egg and Capitial - After two letters not reponded.

Lloyds - On going, but they have said they can show they sent me a default notice and will now remove the default from my file.

Halifax - Admit they did not send me a default notice, but will not remove it from my credit file, becuase they say the fact that that i have an IVA on file is worse than a default, and they dont see that it will do any good to remove my default and refuse to, so leaglly they have to remove it and i am now going to seek legal advice on principle because they have broke the law, does any one know some one that can help with this

It is a forum which have all sorts of people trying to remove defaults for whatever reason. It also gives guidance, template letters to send the banks. Sign up and have a look round.
Not sure what happened but I am all paid up and finished...they even owe me money now :)))

James, have you written to the Information Commissioner? If a creditor won't update your credit file you should contact the ICO as they have the power to force them to do it.

Regarding Egg, have you checked your file since you wrote to them? They didn't reply to me but they still updated my file.

I've updated my blog with links to the credit reference files, a copy of the letter I sent to my creditors and links to find the data controllers for each company and in case none of that works, there's a link to the Information Commissioner.

Exactly. Admittedly I haven't contacted the ICO, but the rest of it really isn't difficult and I'd begrudge paying for something I can do for the price of a few envelopes and stamps.

There are enough sites on the internet with template letters on for just such an occasion.

Who the dickens gave banks the autocratic right to decide not to remove defaults!! They have failed in so many areas this is one area they should not have sole discretion on.

They should remove defaults that are no longer correct automatically.

They do have to do it, they don't have a choice which is why if you have any problems you need to contact the ICO.

I agree with all of your comments.

I have spent the last 4 months getting a ccj removed from my credit file which was judged after the creditor had agreed to my IVA, Therefore i settle the debt via my iva and therefore am unable to satisfy a ccj which has been settled via the iva.

The whole thing is a disgrace, experian are useless and will put anything unsubstanciated or not on your file, the courts are just as bad.
