When we entered into our IVA 7 months ago we was told by payplan that our council tax arrears had also been transfered into the IVA, £500+ worth.

Ive just had an email from my council to say we still owe £1100 between now and march 2013. As far as i was aware we owed £460 between now and march 2013 3 payments of £153. The council have said to me that payplan havn't sent any documentation what so ever to them regarding payments etc and as far as they are concerned i owe them £1100. No way can i afford £1100 in 3 months.

Seems a big cock up with payplan and the council, A not spoke to B or vice versa yet im the one stuck in the middle with an £1100 bill to pay.

Payplan are closed for christmas, the council rang me today for a payment
Advice please....

Well .. the Council won't be pressing for payment of arrears before the end of the financial year, so forget them for a while ( incidentally, none of this is down to the Council -- it all rests at Payplan's door!).

As soon as Payplan get back from their break, get them to contact the council as a matter of urgency.

Foggy, slight correction in that the Council will need this addressing by end of January. Council Tax is a 10 month year - April to February

Yeah ive just emailed them. Obvouisly there is a huge cock up on someones part. The council been sending me letters this week telling me ive got £1100 to pay, far as i was aware it was £460. On my payplan creditors it says that the council are one of my creditors. Will leave it with payplan.If i do have to pay the arrears then i will tell payplan i wont be paying them the £200 i give them a month, that can go towards the arreas over 3 months.

aah, if they are last years/arrears, Foggy could be correct in that you will have until the end of March, because that has been factored in by the Council. Oddly, its only current bills that run Apr to Feb. In any case, its Payplan's lash up, so put pressure on them.

The payments can be made over a 10 month year, in some, if not all councils the tax payer can also opt for a 12 month year, if they so wish ( making smaller payments each month). However, the Council's financial year is the same as the tax financial year.

I make mine over 12 months. U get the option on the direct debit form

Some Council's will start legal proceedings if just one month is missed. They are all different.

I'm surprised this has occurred. Have you checked your Chairman's report for list of agreed creditors?

Hi,

Your council tax arrears have been included in your IVA and will receive payments from us. They are legally bound by the IVA so cannot take any further action against you. I can see from your notes that your case officer has received your emails and is doing her best to sort this out for you.
