Could we change our Insolvency supervisor ?.

Mt wife and I currently have an IVA with Debt free direct but are unhappy with the level of service and advice. Could we change our Insolvency supervisor ?. Or would Bankruptcy be an option

Hi Patrick

Welcome to the forum. Once in an IVA it is almost impossible to change your IP. BR is always an option that is open to you. If you can post some details about the problems you are having one of the experts will be able to give you some advise.

The problem with DFD is that they are such a massive company which makes it really hard to speak to the same person twice and absolutely impossible to speak to your IP.

The best thing to do is find his email address on the insolvency website under the heading "find an IP"
Email him/her direct......That worked for us, although we didnt actually get to speak to IP but we were then able to communicate with the lady that answered the email on behalf of the IP.
She proved to be very helpful.

Please don't think about bankruptcy just because you are having difficulties with the firm administering your IVA. These can usually be worked out, as Mrs Skint has experienced, by persistent communication.

No Mel not yet. We were told about 2 weeks ago that it was all drawn up and waiting to be signed by the supervisor and we should have it very soon.
Its a joke, how heavy is that pen?

Keep being a pest and they will soon tire of your calls and send you the document. Why not say that on Friday you will be driving to their offices to collect the documents or see the IP personally to receive an explanation why the paperwork has not been signed. Might just do the trick, as Mr Skint has been there before hasn't he?

Patrick, whilst theoretically you can apply to Court if you are unhappy with any act or omission by the Supervisor, and whilst theoretically the Court could replace the Supervisor this is highly unlikely to happen. The grounds would need to be much stronger than simply the fact that you are unhappy with the service level and advice.

Also, Bankruptcy on those grounds would be a bit like a sledgehammer to crack a nut.

Specifically, what is the issue concerning you?
