Still no word from the landlady which is even more frustrating as she obviously knows what position she's putting us in. The shower has developed a fault too we think (i'm guessing a burning smell and smoke isnt a good sign?!) but I'm wondering if she'll even respond to us about that given the situation!
Phoned the agent Thursday and surprisingly have had no response from them either..

I've put an ad on Gumtree detailing what we want so hopefully that might spur a few people on. Hopefully going to view a house later today too
Am trying to stay positive about it all and at least this means we can hopefully find somewhere we really like and make it home. My son last night told me he hates the house as the garden has no grass and there's nowhere for a trampoline so I guess he sums it up really! Onwards and upwards...hopefully! [:D]

Update..still no word. Getting more annoyed by the day now [:(!]
Tried ringing her yesterday about the faulty shower..which technically we shouldn't even be using and surprise surprise both mobiles switched off.
Tried to go through letting agent who will apparently try and get hold of her for us. Conveniently the letting agent still has no update on the house sale/move out situation either!
Feeling even more disappointed to be honest..am seriously contemplating putting a formal complaint in about the agent! Grrrrr!

Hang in there Vimto, I feel annoyed for you. It'll come good in the end. Very best wishes and I'm routing for you. (Just a thought maybe is the shower safe? have you mentioned it in this way
to the agent? if you have an email address for them and email it in so it is in writing you may suddenly get more of a response).

I'm not sure how safe the shower is to be honest..i'm guessing the burning smell isnt a good sign so at the moment we are having the quickest showers ever and my son is having a bath just in case. When we spoke to the agent we stressed the fact there is a burning smell but as of now (11am) still no response!!
To be honest Niobe I don't want to see her..i'm so disappointed with her behaviour and she obviously knows she's done wrong due to the lack of contactability (if thats even a word?!)

And to add fuel to my stresses now..my child benefit has been stopped because my idiot of an ex is trying to claim it aswell!! I've just phoned them for an update and they've told me it's gone to the dispute section for them to make a decision as to who should get it! Surely the fact he has to pay me through the CSA should be proof enough?!?!?!? If they suggest he should...oh they'll be an appeal!!

Oh and...if anyone is planning on playing the euromillions tonight..and win..please could i have some..not a lot..just a little bit please [;)]

Latest update is the letting agent has been round to her house, and the way the cars are parked etc and the look of the house suggests she's on holiday!! Fuming isnt the word!!! We have no idea for how long or anything! So now we are not only in limbo about the house but also as to what to do with the shower! The agent has suggested we don't use it lol but that doesnt really help us considering for all we know she could be away for weeks!!
Faith is gradually slipping away...can't wait to get out now!!

Hi Vimto,

I really feel for your situation.

I am also a Landlord and cannot understand why other Landlords risk their tenants safety (and lives), or risk damage to the house. So here's what I would do if I were you:

1). Check your tenancy agreement: Agree with Oscar's post - usually with an 'assured shorthold tenancy' there is a 2-month notice period that has to be given to the tenant if the LL wants to sell up;

2). The shower issue sounds VERY dangerous, and potentially life-threatening. Please stick to baths for now until it can be sorted.

3). If you feel that you are being harassed into leaving (ie: by LLs/letting agents failure to repair faults within a reasonable timeframe), or frankly if the letting agent needs a kick up the backside, have a word with the local council's Environmental Health Dept. They have all manner of powers under the housing act etc. to serve repair notices or carry out works in default, to improve housing standards. The owner / letting agent wont want this to happen, as it makes life very difficult if you are trying to a property with an unresolved statutory notice/land-charge hanging over the building.

4). Regarding your deposit: presumably you put one down on the existing property, which should be held impartially in a tenancy deposit scheme, so providing you have kept the place in reasonable order, you should get this back.

I've just picked up on this latest string to this thread and am very concerned. Burning smells from an electric shower and water simply don't go and are highly dangerous. You MUST folow UpToMyNeckInIt's advice and at least get a plumber to come round and give you a quote. They won't necessarily charge for this, but at least you will know what the problem is.

I would personally withhold rent until this is sorted - and please don't use the shower until it is checked out. What part of the country are you in Vimto?

With our tenancy the letting agents have authority to get emergency work carried out. I would ask the agent if they can do this.

But as the others have said - don't use the shower. Too risky in my opinion.

Mel - I'm in Birmingham. We have considered getting a quote to see what's wrong and how much it would cost to fix but then we risk potentially paying to get it fixed and have the landlady (whenever she decides to come back and get in touch) refusing to reimburse us. The letting agent hasn't been much help either really. She's said she can't do anything but advise us not to use it!

I've checked the tenancy agreement and there's no mention at all about notice period. The agent has said it is 2 months and we have to give 1 so at least there's that for now

Just feel really let down by it all..until now we thought we had a good relationship with the landlady but feel that this has now gone instantly. We still can't help but think there's something more than her just wanting to retire/sell..guess we'll never know. All we do know is that it has made us decide we want out and having agreed payment breaks with DFD we're ploughing everything into savings to be able to afford to do so

Things can only get better...I hope!! I'm feeling so fed up and such a failure at the moment [:(]

you are not a failure in fact in your sons eyes you are exactly the opposite, I am sure he worships you and will do no matter where you live, so you hang in there. You are also a star in your own right, continuously helping others on this forum, despite having your own problems to deal with. hugs

Thanks Oscar, I wish I could be positive but I feel like everything is really getting to me at the moment and I don't know what to do about it [:(]
I'm usually quite positive and optimistic but can't help but think I'm jinxed or cursed. I feel like I am continually letting people down and disappointing everyone around me and I'm really struggling to hold it together at the moment [:(]
