Thanks for that Oscar..I've just checked out 'Assured Shorthold Tenancy Agreement' and it mentions nothing about a notice period! I even did a search for some of the key words in your post and nothing!! [:(]

When my partner asked the agent about having to know before Friday because of the 4 weeks she merely said 'i would't worry about that'...to be honest they are actually estate agents who have recently gone into lettings..but i'm thinking they should have just stayed with what they knew best!

Spurred on by Oscar, I phoned up about a property we've seen and kinda explained the current tenancy situation and she confirmed that they have to give us 2 months notice and we them 1.
Think all of this has made us realise we don't even want to live there anymore! Now just to try and find about £1200 so we can finally find ourselves a proper home!! Anyone wanna rob a bank with me? [;)]

Hi Vimto, I hope you are able to raise the funds to find a new home in the private rented sector.
To add to previous posts, your LL does have to give you 2 months notice, it's the law. Even when the notice period has expired, you still have a legal right to remain in the property and you LL will have to go to court to get you out.
If your LL does serve you with a notice, I would advise you to go to your local authority (LA) housing department. They will check first of all that the notice is valid as the 2 months has to start from the date your next rent payment is due, and if the date is incorrect or anything else on the notice is incorrect, the notice will be in-valid and your LL will have to serve a new one.
Your LA should also assess your circumstances, and after investigation, if you are classed as priority need, (ie. pregnant, have dependent children, mental health/vulnerability issues) they should award you priority status on their housing register. They may also operate a bond guarantee scheme to help you with alternative private rented accommodation. I would advise you to remain in your current home as long as you legally have the right to remain there if you do not find another home as the LA will discharge their duty to house you.

Thanks for all your comments and support people! It's not great is it!
Because of all this we've lost all faith in our landlord now and want nothing more but to move now..problem is finding £1500 for deposit and credit checks! Is there anything/anyone we could go to for this give. Our circumstances? We've already tried family to no avail [:(]
Without wanting to sound ungrateful we want to try and avoid going down the council route..the houses and council areas around me are terrible and not where I'd want to bring my son up!

Just spoke with DFD, arranged a payment break! Will help a bit so now to save save save! So glad we've done Park savings this year..at least my son will get some presents!!

You don't need to just go to the council Vimto, speak to the housing associations aswell, they rent out 'normal' everyday houses in nice areas aswell, even if they have nothing now it perhaps might be worth getting on their waiting lists.

My brother has rented for the past 6 years after he was repossessed and this is one of the pitfalls, you can never trust what potential landlords say to you, at the end of the day they will only have their interests at heart, not their tenants, I would probably now in your position try to only look for a property that is up for rent from a landlord who is not someone new to the game, or someone who has tried to sell but can't and is willing to rent, these are the ones who will do it for a short term and then realise that it's not for them or they just want to sell up and get rid. I know that's easier said than done when time is not on your side but you don't really want to be uprooting your family every few months.

I think aswell I would try and stay with your current agent, at least they know your history and will possibly be able to sway any potential landlords views regarding the IVA as you have history of being a good tenant now.

Is it absolutely necessary that you have to pay for another credit check when you know it will fail?

just one suggestion - (only if the facts are right though)

Is there any way you can speak personally with the Manager of your current agent and stress that they just did a check 6 months ago, say e.g. "look, if I stayed with the current landlord you would not suddenly do another credit check after 6 months, I have already paid for this credit check less than 6 months ago - therefore it seems totally unreasonable, especially when you knew my circumstances and were happy to grant me a tenancy in the first place, to suddenly require another credit check 6 months down the line, especially when I have been a good tenant and I was definitely assured that the tenancy I undertook was long term. I would like it confirmed , for how long are these checks, for which I have already paid you, actually valid?"

I bet they won't know for how long they are valid because they don't know what they are doing themselves fully maybe?

This agent should want to keep your business - maybe if you say you don't want to go to another agent necessarily but they could loose business by being short sighted and it would be a shame all round? the main thing is stay calm and focussed because if you get angry this will make things worse. Don't do it unless you have to, but iIf push comens to shove say you feel totally misled/misold even and will need to obtain further advice.

Thinking of you at what must be a totally frustrating time. If it would do any good I'd kick some a..e for you but it would not help unfortunately. Very best wishes. hang in

I would definitely take up Oscar's advice about approaching your letting agent.[:)]

Re approaching your local council - most authorities now administer a choice based lettings scheme and work in partnership with housing associations and private landlords who advertise their vacant properties for applicants on the register to "bid" on, so only apply for homes you actually want to be considered for. Properties are allocated to those in greatest need, so if you are assessed as being in priority need, you stand a good chance of being housed, depending on availability of accommodation in your area. Realise this may not be the route you wish to go down, but would advise you to consider this as a back up.

Hi Vimto,

Sorry to hear of your predicament - and always when you are just trying to get on with your life too !

As you need the money to move on, did you pay a deposit that could be returned at all perhaps ?

It may not be much, but may help !

I really feel for you and always watch out for your posts as we started the journey on the same day. Why don't you put a advertisement in local shops saying you're looking for somewhere to rent, If you just put a Mobile Number on,no-one will know its you. I'm saying beause this is how a friend of mine found someone to rent his house. He is a decent lad who wanted to move up the property ladder and couldn't sell his other House so decided to rent it out. Had bad experienes with Letting Agent and in the end was desperate to get a tenant and didn't ask for a Credit Check,He looks after his tenants well. It just proves all Private Landlords arn't sharks!
