Well 7 days have passed since Cleardebt told me that they rejected all of my complaints and that they have requested that the claims management company escalate the matter to the attention of the Financial Ombudsman Service.

I emailed their Chief Operating Officer Simon Lee today to ask for an update! I asked if they had indeed contacted the claims management company and if so what the expected timescale was now. That was this morning; there was no out of office reply. Also the claims management company promised to advise me if and when they were instructed to proceed with this(they have not contaced me)

This is another 7 days wasted! Cleardebt seem set to keep me hanging on for as long as possible (term of IVA + Variation + 6 months admin time + 6 month extension + 3 month extension) So much for “5 years and you are debt free!” More like “pay as much as possible for 5 years then hang on for another 2 year and 3 months!”

Hello I am new to the forum. I have completed 2 1/2 years on my joint IVA with my husband. We are also with Clear Debt and we received letters off them back in June about any PPI that we had and that they wanted to use a claims company to claim on our behalf and charge 30% to do it! We have only ever taken out PPI on a secured loan which we have, which i claimed back last year and we gave them the money straight away, so we didn't fill thr forms in. We have, however received the forms again today by recorded delivery, so my husband called them and he was tild that if we do not fill the forms out then we are not complying with them and so this can effect our IVA.

I am so annoyed we have never missed a payment and always done and provided everything that they have asked for and now i feel like i am being bullied by them to fill out these forms, when i can definitely say that i have NOT been missold any more ppi! I don't know how they are getting away with this? And when we call them their attitude is awful!

I just wonder who is pocketing the 30% that the company are charging & surely the iva company is getting some sort of referral fee! I can't understand how the creditors are profiting from it because you are taking money off them minus 30% and then giving back to them.

Clear debt have said that they have to do this to comply with David Monds licence or something like that but i am not so sure. I have never spoken to the man and when i have asked to his staff told me that i couldn't and that even if i emailed him he would oass iy back to them to respond to. So what's the point!

Hi Dixie

I know exactly what you mean, but on a plus side you are having this “discussion” with Cleardebt now and not some months after you have made your final payment and are waiting for a completion certificate.

I would suggest that you repost your post in a new thread; I see this morning that Cleardebt’s Tom O Conner has joined the forum and hopefully he can address your concerns?

I would love to know what percentage or kickback some of these larger IVA companies get for making you use their preferred claims management company.

Tom will be a very welcome contributor to the forum - as other of the larger firms have found it is good to have a voice even if only to deal with client complaints.

From www.ico.gov.uk:

"One of the main rights which the Data Protection Act gives to individuals is the right of access to their personal information. An individual can send you a subject access request requiring you to tell them about the personal information you hold about them, and to provide them with a copy of that information. In most cases you must respond to a valid subject access request within 40 calendar days of receiving it."

I have asked the claims management company for copies of all correspondence that they had sent and had received between the banks and between Cleardebt. I believe that this may further show the level of fraudulent complaints that were made in my name but without my knowledge.

They told me that they would only give me this information if I made Subject Access Request which I had to send a cheque for £10 (which they were very quick to cash).

I have a proof of delivery that they received the Subject Access Request on 10th September so I guess they have 40 calendar days from then to provide this information so will be due at the end of this week (no doubt I will be chasing them next week to see where it is).

It will be interesting to see what they disclose.

I have never come across this before - but 40 days would seem very ample to be able to provide copies of documentation. I do hope that you manage to get a resolution on this soon.
