I can't give too much detail for fear of upsetting Melanie and the risk of Andy locking yet another of my threads!

I have taken everyones advice and made an official complaint to my IVA company (not named, not in bold and not in colour)

I have asked them to give me a response within 14 days or else I will raise the matter with the Financial Ombudsman Service, Association of Chartered Certified Accountants and to Debt Resolution Forum.

They have confirmed receipt of my complaint and promised to respond within my timeframe.

I am not looking to further tarnish their reputation, they can do that on their own! I plan to update this post as and when I have an update, possibly in the next 14 days.

I had previosly asked if anyone had had experience with making such complaints but Andy closed my last post before anyone could reply.

Anyway, will keep you posted!

You are not going to upset me - why would you think you would??

Your IP firm have responded to the complaint promptly and have said they will deal with it.

Complaints to regulators are actually quite rare, and I do hope that you manage to resolve your difficulties amicably. Look forward to hearing the outcome.

To add a Frugal Friend

Go into your profile and enter your password when prompted.
Scrool down and you will come to Frugal Friends
Click Add Frugal Friend and add whoever you want.

The other person will need to do so too and then you can converse either here or offline if you give your email address to the person.

I was sorry the thread was locked however I look forward to your updates, I would imagine so would others, I suppose the best way to keep these threads open is not to mention names, however people do come here to learn from others experiences that,s why Melanie is so busy.

Not naming anyone but the ambulance chasers that my IP are making me use are doing really well!

Of the 5 claims that they have made on by behalf they have found:

One account did not even belong to me
Another account did not have PPI on it.
Another has been fully investigated by the bank and they concluded that PPI was not miss-sold.
I wait with baited breath for the outcome on the remaining 2 claims.

Why oh why would they not take my word or let me sign a declaration or waver to say that I had not been miss-sold PPI?

Hi here today.
I totally agree with you on this...it makes me angry too that I.Ps seem to push this mis-sold ppi thing upon us!!..how dare they tell me that i was mis-sold?..I was not and was happy with arrangements I made back then which actually resulted in me never opting for ppi but somehow they still want to pursue a fraudulant claim!!!.
An IVA is a long hard road but valuable lessons have been learnt along the way. Now looking forward to enjoying a debt free future!

The bank that had carried out a full investigation and found that PPI had not been miss-sold quoted an extract of a letter that “I” had sent them. The letter was actually sent by the ambulance chasers.

In a letter sent on my behalf it stated the following:

1) I do not recall the full costs of the policy being explained to me.
2) I do not recollect being advised of the policies main characteristics including Features benefits and exclusions.
3) The adviser automatically included the Payment Protection Policy into my quotation.
4) I was not asked about any existing cover at the time the policy was sold.
5) I was not made aware of the restrictive cancellation nature of this policy

I do not agree with any of these statements and I had not discussed any of them with either my IP or the ambulance chasers. I did not see a copy of the letter and would be none the wiser if the bank had not brought it to my attention.

I am not sure what the correct word or term to describe what is going on here but a couple that springs to mind are Misrepresentation & Fraudulent Claims.

They are clearly doing something wrong but what exactly is it?

If you did not advise the claims company of those points, and they have made them without consultation, they will need to explain why such statements were made in your name. Let the complaint run its way through as I think a lot of us will be intererested to know the outcome.

That is truly dreadful and dishonest how they are behaving!!..how are they getting away with this?..what about data protection? I thought this was still an active law??. They should not be able to act on your behalf without your authorisation? or is mis sold ppi claims exempt from the data protection act?

Whilst I was forced to sign authority for them to investigate claims for miss-sold PPI, I did not give them carte blanche to misrepresent me, make fraudulent claims and blatantly tell lies!

I have update my complaint with my IP via email and I will be contacting the ambulance chasers on Monday.

I hope you don't think that this is me just moaning again. I honestly believe I am being miss treated and getting a hard time from both my IP and the ambulance chasers!

Though I have no experience of PPI claims or even third parties claiming on my behalf, having read this thread I am truly shocked.

First of all I would like to say that I have read your previous threads which were eventually locked and I must confess that I did think that you were maybe over reacting a little. Sorry about that but that is how it came across at the time.

Having read this thread I can now totally understand where you are coming from.

In my opinion any IVA company that employs a PPI claims company should make sure that any claims issued on behalf of their client are as accurate as possible and the only way they can ensure that is the client reading and signing the said statement.

This to me amounts to Fraud and shows that some of these PPI claim firms are far worse than the banks themselves.
